Conditions or Reasons for Planning Application - CB/22/01073/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) No development approved by this permission shall take place until a Phase II site investigation has been undertaken and a detailed report of the findings, in accordance with the recommendations of the Ground Engineering Phase I Desk Study Report dated June 2021 (Ref: C15384), has been submitted to and approved in writing by the Local Planning Authority. Where found to be necessary by the Phase II report a remediation strategy to deal with the risks associated with contamination of the site shall also be submitted to and approved in writing by the Local Planning Authority. The remediation strategy shall include an options appraisal giving full details of the remediation measures required and how they are to be undertaken. The strategy shall include a plan providing details of how the remediation works shall be judged to be complete and arrangements for contingency action.

Reason: To protect human health and the environment, in accordance with Policy CC8 of the Central Bedfordshire Local Plan 2021
3) Prior to any demolition works, the applicant/developer shall apply for and obtain a European Protected Species Licence from Natural England, and either provide the license to the Local Planning Authority, or provide a statement from Natural England advising that a licence is not required. A scheme of any mitigation or compensation measures, including timetables for implementation, shall also be submitted to and approved by the Local Planning Authority, and implemented in accordance with any approved details.

Reason: To ensure that the development would not result in harm to protected species, in accordance with Policy EE3 of the Central Bedfordshire Local Plan 2021 and Section 15 of the National Planning Policy Framework.
4) Prior to the occupation of the proposed dwelling a validation report shall be submitted and approved in writing by the Local Planning Authority to demonstrate the effectiveness of any agreed Remediation Strategy. Any such validation shall include responses to any unexpected contamination discovered during works.

Reason: To protect human health and the environment, in accordance with Policy CC8 of the Central Bedfordshire Local Plan 2021
5) Prior to the occupation of the proposed dwelling, a landscaping scheme to include all hard and soft landscaping and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme have been submitted to and approved in writing by the Local Planning Authority. The scheme shall be in line with the indicative layout showing 30% tree cover on plan ref. 1363-SAP-V1-XX-DR-A-10106-SO-09 .The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping, in accordance with Policies EE4, EE5 and EE9 of the Central Bedfordshire Local Plan and Sections 12 & 15 of the National Planning Policy Framework.

6) Prior to the occupation of the proposed replacement dwelling, the buildings shown with red dotted lines on plan ref. 1363-SAP-V1-XX-DR-A-10106-SO-09 shall be demolished / removed from the development site.

Reason: In the interest of improving the character of the area, in accordance with Policies DC2 and HQ1 of the Central Bedfordshire Local Plan 2021.
7) Prior to occupation of the proposed replacement dwelling, the proposed development shall be carried out and completed in all respects in accordance with the access siting and layout, parking spaces, cycle parking provision and refuse collection point illustrated on the approved plan ref. 1363-SAP-V1-XX-DR-A-10106-SO-09 and defined by this permission and, notwithstanding the provision of the Town and Country Planning General Permitted Development Order 2015, (or any Order revoking or re-enacting that Order) there shall be no variation without the prior approval in writing of the Local Planning Authority.

Reason: To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate access arrangements at all times.
8) Prior to first occupation of the development hereby approved, all ecological measures and/or works shall be carried out in accordance with the details contained in the Ecological Survey, dated 29th June 2021 - ref 213332/ARB.

Reason: To ensure all impacts to protected species are taken into account and mitigated, in accordance with Policy EE2 of the Central Bedfordshire Local Plan and Section 15 of the National Planning Policy Framework.
9) Prior to the occupation of the proposed replacement dwelling, the junction of the 4.8m widened vehicular access (west) with the highway and the visibility splays shown on plan ref. 1363-SAP-V1-XX-DR-A-10106-SO-09 shall be provided, and shall thereafter be retained in perpetuity.

Reason: In the interest of highway safety, in accordance with Policy T2 of the Central Bedfordshire Local Plan 2021
10) The proposed replacement dwelling shall not be occupied until the optional water efficieny requirement of 110 litres, per day, per person, has been complied with.

Reason: To improve the sustainability of the proposed dwelling in accordance with Policy CC1 of the Central Bedfordshire Local Plan.
11) The development hereby approved shall be implemented strictly in accordance with the recommendations/measures stated in the Precautionary Working Method Statement: Great Crested Newts for Country Kennels, Marston Moretaine (PWMS, AA Environmental Limited, Ref: 213332, April 2022).

Reason: To minimise the impacts of development on biodiversity, in accordance with Policies EE2 and EE3 of the Central Bedfordshire Local Plan 2021 and Section 15 of the National Planning Policy Framework
12) The proposed development shall be carried out in accordance with the recommendations in the submitted document BS5837:2012 Tree Survey and Arboricultural Impact Assessment, ref no. ITS_0175. The approved tree protection fencing shall be maintained until all equipment, machinery and surplus materials have been removed from the site. Nothing shall be stored or placed in any area fenced in accordance with this condition and the ground levels within those areas shall not be altered, nor shall any excavation be made.

Reason: To protect the trees so enclosed in accordance with Policy EE4 of the Central Bedfordshire Local Plan 2021 and Sections 12 & 15 of the National Planning Policy Framework
13) The proposed development hereby permitted will be carried out in accordance with the final ground levels and ridge heights as demonstrated on plan ref.1363-SAP-V1-XX-DR-A-20100-SO-04

Reason: In the interests of the rural amenity of the area, in accordance with Policies EE5 and HQ1 of the Central Bedfordshire Local Plan 2021.
14) The proposed replacement dwelling hereby permitted will be constructed in accordance with the materials as outlined on plan ref. 1363-SAP-V1-XX-DR-A-30350-SO-09, unless otherwise agreed in writing by the Local Planning Authority.

Reason: To control the appearance of the dwelling in the interests of the rural amenity of the area, in accordance with Policies EE5 and HQ1 of the Central Bedfordshire Local Plan 2021.
15) Notwithstanding the provisions of Schedule 2, Part 2, Class A of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), other than those shown on plan ref. no 1363-SAP-V1-XX-DR-A-10106-SO-09, no fences, gates, walls or other means of enclosure shall be erected within the curtilage of the property without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the development in the interests of the rural amenity of the area, in accordance with Policies EE5 and HQ1 of the Central Bedfordshire Local Plan 2021.
16) Notwithstanding the provisions of Schedule 2, Part 1, Class A of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions to the building hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the development in the interests of the rural amenity of the area, in accordance with Policies SP7, EE5 and HQ1 of the Central Bedfordshire Local Plan 2021.
17) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
18) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
19) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 1363-SAP-V1-XX-DR-A-10106-SO-09, 1363-SAP-V1-GF-DR-A-101050-SO-06, 1363-SAP-V1-FF-DR-A-10151-SO-05, 1363-SAP-V1-XX-DR-A-30350-SO-09 and 13636-SAP-V1-XX-DR-A-20100-SO-04.

Reason: To identify the approved plan/s and to avoid doubt.
