| Conditions or Reasons: | 1)
The development hereby permitted shall begin not later than three years from the date of this permission.
Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. |
2)
No development shall commence until samples of the materials to be used in the construction of the external surfaces of the development hereby permitted have been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.
Reason: This is a pre-commencement condition to control the appearance of the building in the interests of the visual amenities of the locality. (Section 12, NPPF) |

No above ground level development shall take place until a landscaping and maintenance scheme, to include all proposed planting and details of sizes and densities of proposed planting, has been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.
Reason: To ensure an acceptable standard of landscaping. (Sections 12 & 15, NPPF) |

The final slab level of the building hereby approved shall be constructed in accordance with the height set out on plan no MA/2020-02/08B (Proposed street elevation) as shown in relation to Nos 14 and 16A Hinksley Road. Thereafter the site shall be developed in full accordance with the approved details.
Reason: To ensure that an acceptable relationship results between the new development and adjacent buildings and public areas in accordance (Section 12, NPPF). |

The hard boundary treatment shall be erected as shown on plan no MA/2020-02/01K (Block plan). The boundary treatment shall be completed before the building is occupied and be thereafter retained.
Reason: To safeguard the appearance of the completed development and the visual amenities of the locality and protect neighbour amenity. (Section 12, NPPF) |

All ecological measures and/or works shall be carried out in accordance with the details contained in the October 2021 Preliminary Ecological Appraisal as already submitted with the planning application and agreed in principle with the local planning authority prior to determination.
Reason: To ensure development is ecologically sensitive and secures biodiversity enhancements in accordance with the National Planning Policy Framework. |

All ecological enhancements and future maintenance shall be carried out in accordance with the details contained in the July 2022 Biodiversity Net Gain Report and New Habitat Map V3 as already submitted with the planning application and agreed in principle with the local planning authority prior to determination.
Reason: To ensure development is ecologically sensitive and secures biodiversity enhancements in accordance with the National Planning Policy Framework. |

The development hereby permitted shall be carried out in accordance with the recommendations set out in Section 6 of the Tree Survey Report dated October 2021 (Revised May 2022).
Reason: To safeguard the existing trees on the site in the interests of visual amenity. (Sections 12 & 15, NPPF) |
9)
The building hereby approved shall not be first occupied until details of electric vehicle charging points and their location have been submitted to and approved in writing by the local planning authority. Thereafter the building shall not be first occupied until the approved details have been implemented.
Reason: in the interests of encouraging the use of sustainable modes of transport. |
10)
Details of the arrangements to be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway shall be submitted to and approved in writing by the local planning authority and the approved details shall be implemented prior to the development being brought into use.
Reason: To avoid surface water from the site being discharged into the highway so as to safeguard the interest of highway safety. |

Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the parking provision on the site including 1 visitor parking space shall not be used for any purpose, other than as parking provision unless permission has been granted by the Local Planning Authority on an application made for that purpose.
Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users. |
12)
Prior to occupation, the proposed development shall be carried out and completed in all respects in accordance with the pedestrian visibility splays, dropped kerb for use for the euro bins, location and demarcation of the parking spaces, visitor cycle parking and residential long stay cycle parking lockers illustrated on the approved plan No. MA/2020-02/01K and Drg 1 Falco cycle store/ photo cycle lockers and defined by this permission and, notwithstanding the provision of the Town and Country Planning General Permitted Development Order 2015, (or any Order revoking or re-enacting that Order) there shall be no variation without the prior approval in writing of the Local Planning Authority.
Reason: To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate access arrangements at all times. |
13)
The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.
Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF) |
14)
All existing onsite buildings and other structures shall be demolished and all resultant detritus completely removed from the site prior to the commencement of building works.
Reason: In the interests of the visual amenities of the area. (Section 12, NPPF) |
15)
The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers:
