Conditions or Reasons for Planning Application - CB/22/01191/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to development, all tree removal required to facilitate development shall be confined to that specified in Appendix 2 "Survey Schedule" and as specified in Section 6.1 of the supporting document "Tree Survey Report Pre-Development", dated August 2022, as prepared by RGS Arboricultural Consultants.

Reason
To ensure that only tree removal required to facilitate development is carried out, thereby avoiding unnecessary and unjustified felling, which would be to the detriment of visual amenity.
3) Prior to development all tree protection barriers and ground protection shall be installed and positioned in accordance with Appendix 3 "Tree Constraints / Protection Plan" and Sections 6.2 and 6.3 of the supporting document "Tree Survey Report Pre-Development", dated August 2022, as prepared by RGS Arboricultural Consultants. The tree protection barriers and ground protection shall then remain securely in position throughout the entire course of development works.

Reason
To protect the designated Root Protection Area of the off-site tree T8 from compaction damage due to development activity, so as to safeguard its health, stability and amenity value.(Policy HQ1 of the Local Plan 2015-2035 and Section 2, NPPF)
4) Prior to commencement of development, a triangular vision splay shall be provided on both sides of the vehicle access and shall measure 1.8m along the fence, wall, hedge or other means of definition of the front boundary of the site, and 1.8m measured into the site at right angles to the same line along the side of the access. The vision splays so described and on land under the applicant's control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason:
To provide adequate visibility between the existing highway and the vehicle access, and to make the access safe and convenient for the traffic which is likely to use it. (Policies HQ1, T2 & T3 of the Local Plan 2015-2035 and Sections 9 & 12, NPPF)
5) Before the new development is brought in to use all on site vehicular areas shall be surfaced in a stable and durable materials (not loose aggregate) in accordance with details to be approved in writing by the Local Planning Authority. Arrangements shall be made for surface water drainage from the site to soak away within the site so that it does not discharge into the highway or into the main drainage system.

Reason:
To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits. (Policies HQ1, T2 & T3 of the Local Plan 2015-2035 and Sections 9 & 12, NPPF)
6) Before the new development is brought into use, the parking scheme shown on plan no DD 22/023.1A shall be completed and thereafter retained for this purpose.

Reason:
To ensure the provision of car parking clear of the highway. (Policies HQ1, T2 & T3 of the Local Plan 2015-2035 and Sections 9 & 12, NPPF)
7) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers DD 22/023.1 REV A and DD 22/023.2.

Reason: To identify the approved plans and to avoid doubt.
