Conditions or Reasons:

1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

2) The premises shall only be open to customers between the hours of 09.00 to 23.30 Mondays to Fridays; 09.00 to 23.30 Saturdays; 9.00 to 23.30 on Sundays and Bank Holidays and at no other time without the prior approval in writing of the Local Planning Authority.

Reason: To safeguard the residential amenity which the occupiers of neighbouring properties might reasonably expect to enjoy. (Section 12, NPPF)

3) No deliveries shall be undertaken at the site outside the hours of 8am and 6pm Monday to Saturdays, and not at all on Sundays or Bank Holidays.

4) The development hereby permitted shall not open to the public until the noise mitigation scheme as identified in the Clement Acoustics Ltd report (Ref: 17625-NIA-01) dated 8th June 2022 has been implemented in full. The approved scheme shall be retained in accordance with those details thereafter.

Reason: To safeguard the residential amenity of neighbouring properties. (Section 12, NPPF)

5) Details of the refuse collection strategy for the proposed development shall be submitted to, and agreed in writing, prior to the first occupation of any development hereby permitted. This should include:
Specifying the location, size and details of any refuse storage area;
Confirmation of means of access to and from the refuse storage area, to be retained throughout the life of the development; and
Confirmation that the refuse collection will be undertaken by a private contractor.

Reason: In the interest of amenity and in order to minimise danger, obstruction and inconvenience to users of the highway and the premises. (Section 9, NPPF).

6) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers HS-1402-EPGFP, HS-1404-PBP, HS-1404-EBP, CBC-001.

Reason: To identify the approved plan/s and to avoid doubt.
