Conditions or Reasons for Planning Application - CB/22/02087/FULL
Conditions or Reasons:
1) The proposed development is of a siting, scale, form and design which is out of keeping with and detrimental to the pattern, grain and character of surrounding development. The design and layout is considered to be poor with inadequate inside and outside living space for future residents. As such, the proposal would be contary to H2 and HQ1 of the CBLP (2021), Section 12 of the NPPF and the Design Guide.
2) The Council considers that the proposed development would by reason of its proximity lying within a 12.6k metre linear distance of the Ashridge Commons and Woods Site of Special Scientific Interest within the Chiltern Beechwoods Special Area of Conservation would add to the recreational disturbance in this area likely to harm the integrity of the conservation purposes of the Chiltern Beechwoods Special Area of Conservation. In the absence of a legal obligation to secure an appropriate mitigation strategy to the satisfaction of the Local Planning Authority, the proposal would be contrary to the Habitat Regulations and paragraphs 180 and 181 of the National Planning Policy Framework 2021 and Policy EE3 of the Central Bedfordshire Local Plan
3) The proposed development fails to make adequate provision for a safe and convenient driveway and if approved would result in obstruction on the public highway, which would create conditions of danger and inconvenience to users of the highway.The proposed development would also make inadequate provision for the parking of cars and would lead to an increase in on-street parking thereby resulting in unacceptable traffic congestion and additional hazards for highway users and the local Residents contrary to Policy T3 of the Adopted Local Plan, the Design Guide for Central Bedfordshire and Section 9 of National Planning Policy Framework
4) Insufficient information has been provided to enable an accurate assessment of the application in terms the impact on ecology. If permitted could lead to unacceptable impacts on the public open space and ecology. As such the proposal is contrary to Policies HQ1 and EE2 of the Adopted Local Plan and Sections 12 of the NPPF.
5) The proposal would represent a contrived form of development and does not respect the setting or existing built environment. The location of the proposal would see the loss of open space provision which is a valuable feature within the character of the area and would devalue the surrounding footpath links accessed through this area of open space. The proposal would therefore have a detrimental impact on the character and appearance of the area and the use of the adjoining footpaths links and therefore would conflict with Policy HQ1 of the Central Bedfordshire Local Plan, the National Planning Policy Framework (2021) and the Central Bedfordshire Design Guide.
