| Conditions or Reasons for Planning Application - CB/22/03193/FULL |
| Conditions or Reasons: | | 1)
The change of use of agricultural land to a dog exercise area, associated erection of fencing and hard standing represents inappropriate development in the Green Belt, which is, by definition, harmful to the Green Belt. The development is also detrimental to the openness and visual amenity of the Green Belt, in a spatial and visual sense, and represents an encroachment into the countryside. No factors which could amount to very special circumstances to clearly outweigh the harm to the Green Belt, are evident. Moreover, the proposal would not respect the character and beauty of the open countryside, nor would it conserve and/ or enhance the character and appearance of the area. The proposal is therefore contrary to Policies SP4, HQ1, and EE5 of the Central Bedfordshire Local Plan, and Sections 12, 13 and 15 of the National Planning Policy Framework. |
2)
Development in rural areas should be located, designed and landscaped in such a way that it minimises the impact on the countryside and, in particular, that it is sited within existing settlements. The proposal is outside the natural limits of the village of Husborne Crawley and would be an intrusion into the countryside, detrimental to its appearance and rural character. (Policies HQ1, SP4 & SP7 of the Local Plan 2015-2035 and Sections 12 & 13 of the NPPF) |
| 3)
The proposal conflicts with policies HQ1, CC3 and CC4 of the Central Bedfordshire Local Plan and Sections 12 and 14 of the NPPF as the proposal is sited within a 9m easement of an existing watercourse obstructing access for the Bedford Group of Drainage Boards and the existing boundary fencing spacing is under the minimum requirement of 100m x 100mm considered acceptable by the Environment Agency. These policies state that there will be a presumption against development in flood plains or in areas of flood risk where, in the opinion of the Local Planning Authority in consultation with the Environment Agency or Internal Drainage Board, the proposed development would be at risk from flooding or would result in an increased risk of flooding elsewhere. To permit this proposal would be in conflict with these policies. |
