Conditions or Reasons for Planning Application - CB/22/03497/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers: 09643/100, 09643/101, 98643/102, 09643/103, 09643/104, 09643/105, 09643/106, 09643/107, 09643/108, 09643/109, 09643/115.

Reason: To identify the approved plan/s and to avoid doubt.
3) Prior to any plant or equipment permitted by this development being first brought into use, a scheme shall be submitted for approval to the Local Planning Authority to demonstrate that the rating level of sound emitted from the kitchen extraction system and any external fixed plant and/or machinery associated with the development shall not exceed the typical background sound level at any sound sensitive premises. All measurements shall be made in accordance with BS4142:2014 (as amended). The approved scheme shall be fully installed and operational prior to the first use of the kitchen extraction system and/or any other external plant.

Reason: To protect the amenities of nearby residents.
4)
Prior to any kitchen extraction system being installed, a scheme containing full details of arrangements for internal air extraction, odour control, and discharge to atmosphere from cooking operations, including any external ducting and flues, shall be submitted to and approved in writing by the local planning authority. The works detailed in the approved scheme shall be installed in their entirety before the kitchen extraction system is first used. The equipment shall thereafter be maintained in accordance with the manufacturer's instructions and operated at all times when cooking is being carried out unless otherwise agreed before hand in writing with the local planning authority.

Reason: To protect the amenities of nearby residents.
5) Prior to any works taking place to the extensions hereby approved an Arboricultural Impact Assessment and Tree Protection Method Statement shall be submitted to and approved in writing by the Local Planning Authority and the approved details shall be complied with prior to any construction on site.

Reason: To safeguard trees on the site.
6) No development relating to the extension of the village hall community building shall take place until details of the sound reduction index performance of the construction materials of the hall extension are submitted to the Local Planning Authority for written approval. (To include amongst other details, wall and roof structure, glazing, door sets and ventilation system.)
The scheme for the hall extension shall achieve the standards stated in part i) and ii) below. No village hall community building extension hereby permitted shall be occupied or the use commenced until the sound insulation scheme has been implemented in full.

Between 07:00 to 23:00 hrs during the day noise from within the proposed development, including music and sounds of patrons shall cause no increase in the Laeq (5min) or more than a 2dBA increase in the Leq (5min) both in the 63Hz and 125Hz octave bands measured or predicted 1.0m from the nearest noise sensitive or residential façade or at 1.2m above any adjacent garden, terrace, balcony or patio. For all other octave bands there shall be no increase.
 ii) Between 23:00 to 07:00 hrs, during the night, noise from within the proposed development, including music and sounds of patrons should cause no increase in the LAeq5min or Leq5min in all third octave frequency bands measured or predicted at 1.0m from the nearest noise sensitive or residential façade.
7) The development hereby permitted shall be undertaken in full accordance with the Council's adopted 'Construction Code of Practice for Developers and Contractors'
