Conditions or Reasons for Planning Application - CB/22/03585/FULL
Conditions or Reasons:
1) The proposed development is of a siting, scale, form and design which is out of keeping with and detrimental to the pattern, grain and character of surrounding development. The development represents a contrived form of development, constituting backland development and pays no respect to the setting or existing built environment. The proposal does not therefore represent a sustainable form of development in terms of the environmental objectives and conflicts with policies HQ1 and HQ8 of the Central Bedfordshire Local Plan, the National Planning Policy Framework (2021) and the Central Bedfordshire Design Guide.
2) The Council considers that the proposed development would by reason of its proximity lying within a 12.6k metre linear distance of the Ashridge Commons and Woods Site of Special Scientific Interest within the Chiltern Beechwoods Special Area of Conservation would add to the recreational disturbance in this area likely to harm the integrity of the conservation purposes of the Chiltern Beechwoods Special Area of Conservation. In the absence of a legal obligation to secure an appropriate mitigation strategy to the satisfaction of the Local Planning Authority, the proposal would be contrary to the Habitat Regulations and paragraphs 180 and 181 of the National Planning Policy Framework 2021 and Policy EE3 of the Central Bedfordshire Local Plan
3) The proposed development fails to make adequate provision for a safe and convenient driveway and if approved would result in obstruction on the public highway, which would create conditions of danger and inconvenience to users of the highway.The proposed development would also make inadequate provision for the parking of cars and would lead to an increase in on-street parking thereby resulting in unacceptable traffic congestion and additional hazards for highway users and the local Residents. The proposed development fails to make provision for the storage and parking of cycles and therefore fails to promote sustainable modes of transport. The proposed development fails to provide a turning area which is suitable for light goods vehicles as a result would lead to service/delivery vehicles having to manoeuvre from or to St. Andrew's Walk in reverse gear leading to additional hazards for highway users. The proposed development would be contrary to Policy T2 and T3 of the Adopted Local Plan, the Design Guide for Central Bedfordshire and Section 9 of National Planning Policy Framework
