Conditions or Reasons for Planning Application - CB/22/03838/FULL
Conditions or Reasons:
1) The turning area for the service/delivery/ambulance sized vehicle is not within the red/blue line plan (ownership of the applicant) and is instead in third party land and cannot be secured for the perpetuity of the development for the manoeuvring of vehicles to allow them to egress the site in forward gear. This will lead to vehicles reversing into a busy classified road and along an access well used by both vehicles, cyclists and pedestrians and will position the driver of the vehicle outside of the visibility splay envelope at the junction with the highway and will lead to issues of substandard visibility to the oncoming traffic and to the detriment of safety of users of the site and the highway. The proposal would therefore be contrary to Policy T2 and HQ1 of the CBC Local Plan and Section 12 of the NPPF.
2) The proposal if permitted makes no adequate provision for waste collection and/or a turning area for a waste vehicle if it enters the site. This will lead to vehicles reversing into a busy classified road and along an access well used by both vehicles, cyclists and pedestrians and will position the driver of the vehicle outside of the visibility splay envelope at the junction with the highway and will lead to issues of substandard visibility to oncoming traffic and to the detriment of safety of users of the site and the highway. The proposal would therefore be contrary to Policy T2 and HQ1 of the CBC Local Plan and Section 12 of the NPPF.
3) The proposal by virtue of its large-scale flat roof design at two storey level would create an unsympathetic design and appearance which would not be inkeeping with the visual amenity of the area. The proposal would therefore not be considered high quality design, conflicting with Policy HQ1 of the CBC Design Guide and Section 12 of the NPPF.
4) The proposal by virtue of the proposed first floor windows on the northern elevation serving the bedrooms of unit FF3 would directly face onto the private amenity space belonging to No. 9 to 12 the Vines and would therefore create an unacceptable overlooking impact. As such the proposal would have a detrimental impact upon the privacy of the neighbouring properties and would therefore not constitute high quality design, contrary to Policy HQ1 of the CBC Local Plan and Section 12 of the NPPF.
