The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers PL000 Rev D, PL001 Rev D, PL002 Rev D, PL010, PL011, PL012 Rev D, PL200 Rev B, PL201 Rev B, PL202 Rev B, PL300 Rev B, PL301 Rev B, PL302 Rev D, PL64, CS/LMRCB/020 F - Cross Sections of Footpath 16 and 16a and informal link, LP/LMRCB/020 H - Landscape Plan, TPP/LMRCB/010 D, CBC/001 - Pond Section, 1041-SDS-00-XX-DR-C-1000 P14, PL060, PL061, PL062, PL063, PL064, 1041-SDS-00-XX-DR-C-4000-P09, CBC/002 - North Retaining Wall, CBC/003 - South Retaining Wall, Land at Mancroft Road Landscape Statement, Arboricultural Report for Mancroft Road and Ecological Mitigation, Enhancement and Management Report V2
Reason: To identify the approved plan/s and to avoid doubt. |

Prior to development, all pre-development tree work shall be confined to that specified in Section 11.0 "Pre-Development Tree Works" of the supporting document "Arboricultural Report" dated September 2024, as prepared by DCCLA, and shall be carried out by qualified arboriculturists, working in full compliance with BS 3998 : 2010 "Tree Work -Recommendations".
REASON To ensure that only the minimum tree work required to accommodate development and access is undertaken, so as to avoid unnecessary and unjustified tree surgery or felling, and that such tree work is carried out to a high standard of expertise and workmanship. |

Prior to development, and following all pre-development tree work, all tree protection barriers and ground protection shall be positioned and erected in strict accordance with Section 12.0 "Tree Protective Fencing", and Section 13.0 "Ground Protection Measures" of the "Arboricultural Method Statement", and the "Tree Protection Plan" (Drawing No. TPP/LMRCB/010 E), all of which form part of the "Arboricultural Report" dated September 2024, as prepared by DCCLA. The tree protection fencing and ground protection shall then remain securely in position throughout the entire course of development works.
REASON To ensure that the designated Root Protection Areas of retained trees are suitably protected from all development activity, either by a Construction Exclusion Zone or adequate ground protection over their rooting systems. |

Throughout the entire course of development works, all construction operations shall adhere to the methodology specified in the "Arboricultural Method Statement", namely Section 9.0 "Phasing of the Works", Section 14.0 "Installation of 'No-Dig' Surfacing", Section 15.0 "Further Site Investigations and Foundation Design", and Section 16.0 "Site Organisation and Storage of Materials and Plant".
REASON To ensure that all development operations conform to the requirements of good arboricultural practice, so as to prevent damage to retained trees where there has been an operational requirement to encroach into the designated Root Protection Areas of these trees, and where appropriate mitigation measures have been specified in the Arboricultural Method Statement. |
5)
Notwithstanding the provisions of Part 1, Class A, AA and B of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions to the buildings hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.
Reason: To control the external appearance of the building/s in the interests of the amenities of the area. (Section 12, NPPF) |

Notwithstanding the provisions of Part 1 Class E of Schedule 2 to the Town and Country (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no buildings or other structures shall be erected or constructed within the curtilage of the property without the grant of further specific planning permission from the Local Planning Authority.
Reason: To control the development in the interests of the visual amenity of the area. (Section 12, NPPF) |
7)
Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 1995 or any amendments thereto, the parking provision for the site as detailed on the approved plans shall not be used for any purpose other than as parking provision unless permission has been granted by the Local Planning Authority on an application made for that purpose.
Reason To retain adequate parking provision for the development hereby permitted without adversely affecting the convenience of site and road users. |
8)
No above ground development shall take place, notwithstanding the details submitted with the application, until details of the materials to be used for the external walls and roofs of the development hereby approved have been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.
Reason: To control the appearance of the building in the interests of the visual amenities of the locality. (Section 12, NPPF) |
9)
The first floor windows in the side elevations of the development hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the windows which can be opened are more than 1.7m above the floor of the rooms in which the windows is installed.
Reason: To safeguard the privacy of occupiers of adjoining properties (Section 12, NPPF) |
10)
The development hereby approved shall be constructed in accordance with measures outlined within the submitted Ecological Mitigation, Management and Enhancement Plan V2.
Reason: To ensure that species are protected and habitats created. Policy CC3 of the CBC Local Plan. |
11)
Visibility splays shall be provided at all road junctions and private means of access within the site. The minimum dimensions to provide the required splay lines shall be 2.0m measured along the centre line of the side road from its junction with the channel to the through road and 17m measured from the centre line of the side road along the channel of the through road. The vision splays required shall be provided and defined on the site by or on behalf of the developers and be entirely free of any obstruction.
Reason To provide adequate visibility at road junction in the interest of road safety. |
12)
Development shall not begin until the detailed plans and sections of the proposed road(s), including gradients and method of surface water disposal have been approved by the Local Planning Authority and no building shall be occupied until the section of road which provides access has been constructed (apart from final surfacing) in accordance with the approved details.
Reason To ensure that the proposed roadworks are constructed to an adequate standard. |
13)
No dwelling shall be occupied until all triangular vision splays are provided on each side of the all access on to the new road and shall measure 2.8m along the fence, wall, hedge or other means of definition of the front boundary of the site, and 2m measured into the site at right angles to the same line along the side of the new access drive. The vision splays so described shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.
Reason To provide adequate visibility between the existing highway and the proposed accesses, and to make the accesses safe and convenient for the traffic which is likely to use them. |
14)
Before the premises are occupied all on site vehicular areas shall be surfaced in a manner to the Local Planning Authority's approval so as to ensure satisfactory parking of vehicles outside highway limits. Arrangements shall be made for surface water from the site to be intercepted and disposed of separately so that it does not discharge into the highway.
Reason In order to minimise danger, obstruction, and inconvenience to users of the highway and of the premises. |
15)
If the proposed road is not constructed to the full length and layout illustrated on the approved plan, a temporary turning space for vehicles shall be constructed within the site in a position to be approved in writing by the Local Planning Authority before any building taking access from the road is occupied.
Reason To avoid the need for vehicles to reverse into or from the highway in the interest of road safety. |
16)
Prior to first occupation of the development hereby approved, a scheme to show how the pedestrian links within the site connect with the existing pedestrian routes along the south western boundary of the site shall be submitted in writing to the Local Planning Authority. The scheme shall include (if required) widths of paths, surfacing details, levels information, lighting and boundary treatment. The approved scheme shall be implemented prior to first occupation of any dwelling.
Reason: To ensure that safe non-motorised links are provided to and through the site (Policy EE12 of the CBC Local Plan). |
17)
No above ground development hereby permitted shall take place until a plan showing the locations of fire hydrants within the site have been submitted to and approved in writing by the Local Planning Authority. No buildings shall be occupied until the fire hydrants have been installed, and shall thereafter be retained. Reason: To ensure sufficient provision of fire hydrants to meet the requirements of the proposed development. (Policy HQ1, CBLP July 2021, and Section 12, NPPF December 2023) |
