Conditions or Reasons for Planning Application - CB/22/04863/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing building.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality.

3) Prior to development and demolition (including installation of tree protection barriers) all treeworks needed to facilitate development activity shall be carried out in strict accordance with Section 6.1 and Appendix 2 "Survey Schedule" of the supporting document "Tree SurveyReport - Pre Development", dated December 2022, as prepared by RGS Arboricultural Consultants.

REASON
To ensure that only the tree work deemed necessary to facilitate construction enabling worksis carried out, thereby avoiding both unnecessary and unjustified tree work that will not be legally valid under Section 211 of the Town and Country Planning Act 1990, and would be to the detriment of the Aspley Heath Conservation Area.
4) Prior to development and demolition, and following all approved tree works, all tree protection barriers shall be erected and positioned in strict accordance with Section 6.2 and Appendix 3 "Tree Constraints and Protection Plan" of the supporting document "Tree Survey Report -PreDevelopment", dated December 2022, with all tree protection barriers then remaining securely in position throughout the entire course of development works.

REASON
To maintain a secure construction exclusion zone around retained trees, so as to prevent damage from all ancillary construction activity associated with this development.
5) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plan numbers: 101 A, 102 D, 103, 104, 105 E, 106 E, 107 E, 108 E, 109 E.

Reason: To identify the approved plan/s and to avoid doubt.
