Conditions or Reasons for Planning Application - CB/23/00656/MW
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission. Written notification of the date of commencement shall be sent to the Local Planning Authority within 7 calendar days of such commencement.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004 to prevent the accumulation of unimplemented permissions.
2) All external works hereby permitted shall be carried out in materials as stated on the submitted application form dated 01/03/2023.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials in the interests of the visual amenities of the locality in accordance with section 12 of NPPF.
3) No development authorised by this planning permission, other than demolition of the existing building on site, shall take place unless and until a remediation strategy that includes the following components to deal with the risks associated with contamination of the site have each been submitted to and approved in writing by the Local Planning Authority:

(1) A Preliminary Risk Assessment (PRA) including a Conceptual Site Model (CSM) indicating potential sources, pathways and receptors, including those off-site.
(2) The results of a site investigation based on part (1) of this condition and a detailed risk assessment, including a revised CSM.
(3) Based on the risk assessment in part (2) of this condition, an options appraisal and remediation strategy giving full details of the remediation measures required and how they are to be undertaken. The strategy shall include a plan with details of how the remediation works shall be judged to be complete and arrangements for contingency actions. The plan shall also detail a long-term monitoring and maintenance plan as necessary.

Thereafter, the above components of a remediation strategy shall each be implemented as approved.

Prior to the occupation of any part of the development hereby permitted, a verification report demonstrating completion of works set out in the approved remediation strategy in part (3) of this condition, and an updated long-term monitoring and maintenance plan, shall have been submitted to and approved in writing by the Local Planning Authority.

Thereafter, the updated long-term monitoring and maintenance plan shall be implemented as approved.

Reason: To protect and prevent the pollution of controlled waters from potential pollutants associated with current and previous land uses in line with the NPPF (paragraphs 180, 189, 190) and relevant Environment Agency Groundwater Protection Position Statements and to ensure that the development does not pose an unacceptable risk to the environment and contaminated land issues are properly assessed in accordance with section 15 of the NPPF, Policy CC8 of the Central Bedfordshire Local Plan 2021 and Saved Policies GE17 and GE20 of the Bedfordshire & Luton Minerals & Waste Local Plan 2005.
4) If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until a remediation strategy detailing how this unsuspected contamination shall be dealt with has been submitted to and approved in writing by the Local Planning Authority. Thereafter, the remediation strategy shall be implemented as approved.

Reason: To protect and prevent the pollution of controlled waters from potential pollutants associated with current and previous land uses in line with the NPPF (paragraphs 180, 189, 190) and relevant Environment Agency Groundwater Protection Position Statements and to ensure that the development does not pose an unacceptable risk to the environment and contaminated land issues are properly assessed in accordance with section 15 of the NPPF, Policy CC8 of the Central Bedfordshire Local Plan 2021 and Saved Policies GE17 and GE20 of the Bedfordshire & Luton Minerals & Waste Local Plan 2005.
5) No development, other than demolition of the existing building on site, shall begin unless and until a scheme for surface water disposal has been submitted to and approved in writing by the Local Planning Authority. Infiltration systems shall only be used where it can be demonstrated that they will not pose a risk to groundwater quality. The development shall be carried out in accordance with the approval details. No drainage systems for the infiltration of surface water drainage into the ground is permitted other than with the express written consent of the Local Planning Authority, which may be given for those parts of the site where it has been demonstrated that there is no resultant unacceptable risk to controlled waters. The development shall be carried out in accordance with the approved details.

Reason: To protect and prevent the pollution of controlled waters from potential pollutants associated with current and previous land uses in line with the NPPF (paragraphs 180, 189, 190) and relevant Environment Agency Groundwater Protection Position Statements and to ensure that the development does not pose an unacceptable risk to the environment and contaminated land issues are properly assessed in accordance with section 15 of the NPPF, Policy CC8 of the Central Bedfordshire Local Plan 2021 and Saved Policies GE17 and GE20 of the Bedfordshire & Luton Minerals & Waste Local Plan 2005.
6) Piling or any other foundation designs and investigation boreholes using penetrative methods shall not be permitted other than with the express written consent of the Local Planning Authority, which may be given for those parts of the site where it has been demonstrated that there is no resultant unacceptable risk to groundwater. The development shall be carried out in accordance with the approved details.

Reason: To protect and prevent the pollution of controlled waters from potential pollutants associated with current and previous land uses in line with the NPPF (paragraphs 180, 189, 190) and relevant Environment Agency Groundwater Protection Position Statements and to ensure that the development does not pose an unacceptable risk to the environment and contaminated land issues are properly assessed in accordance with section 15 of the NPPF, Policy CC8 of the Central Bedfordshire Local Plan 2021 and Saved Policies GE17 and GE20 of the Bedfordshire & Luton Minerals & Waste Local Plan 2005.
7) The turning areas for vehicles identified by light brown colouring on approved drawing nos. 06 015 1002 rev A; 06 015 1003; 06 105 1004; 06 015 1005; 06 015 1006 and 06 015 201 shall be provided before the building hereby permitted is first brought into use and shall thereafter be retained for the turning of vehicles throughout the lifetime of the development.

Reason: To enable vehicles to draw off, park and turn outside the highway limits thereby avoiding the reversing of vehicles on to the highway in accordance with Policy T2 of the Central Bedfordshire Local Plan 2021.
8) The development hereby permitted shall be undertaken in full accordance with the Council's adopted 'Construction Code of Practice for Developers and Contractors' https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties in accordance with section 12 of the NPPF.
9) The development hereby permitted shall be undertaken in full accordance with the Council's adopted 'Environmental Code of Practice' https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity in accordance with section 15 of the NPPF.
10) The building hereby permitted shall not be used except for purposes ancillary to the existing lawful use of the site as a waste recycling and transfer facility as described in the Certificate of Lawfulness of Existing Use or Development (CLEUD) dated 24 April 2013 (ref. CB/13/00349/MWLE).

Reason: To exercise control over the development and ensure the site does not result in a harmful impact on the surrounding environment in accordance with Policies HQ1 and EE5 of the Central Bedfordshire Local Plan 2021 and saved Policy GE18 of the Bedfordshire & Luton Minerals & Waste Local Plan 2005.
11) No development hereby permitted shall be carried out except in complete accordance with the details shown on the approved drawings, as listed below:

dwg. no. 06 015 1003 entitled 'Proposed Turning Circle 1' (dated Oct 2023);
dwg. no. 06 015 1004 entitled 'Proposed Turning Circle 2' (dated Oct 2023);
dwg. no. 06 015 1005 entitled 'Proposed Turning Circle 3' (dated Oct 2023); and

Reason: To provide certainty on what is being authorised by this permission.
