Conditions or Reasons for Planning Application - CB/23/01006/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The premises shall only be open to customers between the hours of 6am to 8pm Mondays to Fridays, 8am to 11am on Saturdays, and not at all on Sundays and Bank Holidays.

Reason: To safeguard the residential amenity which the occupiers of neighbouring properties might reasonably expect to enjoy.

3) The Noise Management Plan shall be fully implemented in accordance with the details hereby approved on the commencement of the use hereby permitted and retained in perpetuity.

Reason: To protect the amenity of neighbouring residents.

4) Notwithstanding the details shown, visibility splays shall be provided at the junction of the access with the public highway at Sand Lane prior to occupation. The minimum dimensions to provide the required splay lines shall be 2.4m measured along the centre line of the proposed access from its junction with the channel of the public highway and 40.0m to the north east and 59.0m to the south west measured from the centre line of the proposed access along the line of the channel of the public highway. The required vision splays shall for the perpetuity of the development remain free of any obstruction to visibility.

Reason: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.

5) Visibility splays shall be provided at the junction of Sand Lane with the A6 prior to occupation in accordance with the approved plan no. DR-TP-3201 rev P01. The required vision splays shall for the perpetuity of the development remain free of any obstruction to visibility.

Reason: To provide adequate visibility between the existing highway junction of Sand Lane with the A6 and to make the junction safe and convenient for the traffic which is likely to use it.

6) Notwithstanding the details shown, any gates provided at the access with Sand Lane shall open away from the highway and be set back a distance of at least 8.0 metres from the highway boundary.

Reason: To enable vehicles to draw off the highway before the gates are opened.

7) Prior to commencement of the use hereby permitted, all on site vehicular areas shall be surfaced in a stable and durable materials in accordance with details to be approved in writing by the Local Planning Authority. Arrangements shall be made for surface water drainage from the vehicular areas in the site to soak away within the site so that it does not discharge into the highway or into the main drainage system.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits.

8) Notwithstanding the details shown, details shall be submitted to and approved in writing for the following, and the approved details shall be implemented prior to the building being brought into use:

- 7 allocated parking spaces, with details of signage/markings of allocation
- A loading/unloading bay for a 6.5m length service/delivery vehicle
- Tracking diagrams to show the service/delivery vehicle can manoeuvre into/from the loading bay

Reason: For the avoidance of doubt, to provide adequate vehicular parking provision, to provide adequate service/delivery vehicle parking and manoeuvring for the site.

9) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the parking provision for the site shall not be used for any purpose, other than as parking provision unless permission has been granted by the Local Planning Authority on an application made for that purpose.
Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users within the site and obstruct manoeuvring areas.

10) Prior to commencement of the use hereby permitted, a scheme for the secure and covered parking of cycles on the site (including the internal dimensions of the cycle parking area, stands/brackets to be used and access thereto), shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be fully implemented before the approved use is first brought into use and thereafter retained for this purpose.

Reason: To ensure the provision of adequate cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport.

11) The building shall only be used as an indoor gym (Class E(d) of the Use Classes Order) and not for any other use.

Reason: In the interest of the amenities of the area and the amenity enjoyed by neighbouring occupiers.

12) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers CBC.SLP&BLOCK.001 and CBC.FLOOR.002.

Reason: To identify the approved plan/s and to avoid doubt.
