Conditions or Reasons for Planning Application - CB/23/01279/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of drawing number; CBC-002.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally in the interests of the visual amenities of the locality.

3) No development shall commence until details of the junction between the parking spaces and the carriageway of the highway have been submitted to, and approved in writing by, the Local Planning Authority. The junction shall be carried out in accordance with the approved details, amended as necessary by the technical and safety audit process, and opened to traffic prior to the occupation of the dwelling.

Reason: To ensure the provision of appropriate access arrangements in the interest of highway safety.
4) This vision splay shall be provided on each side of each the access drive and shall be 2.8m measured along the back edge of the new highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the footway into the site along the centre line of the anticipated vehicle path. The vision splay so described and on land under the dwelling occupier's control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason: To provide adequate visibility between the new estate road and the new individual accesses, and to make the accesses safe and convenient for the traffic which is likely to use them.
5) The maximum gradient of the vehicular access shall be 10% (1 in 10).

Reason: In the interests of the safety of persons using the access and users of the highway.
6) The dwelling shall not be occupied until all on site vehicular areas have been constructed and surfaced in a stable and durable manner (not loose aggregate). Arrangements shall be made for surface water from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: In order to minimise danger, obstruction, and inconvenience to users of the highway and of the premises.
7) The new dwelling shall not be occupied until a refuse storage area and collection point for the existing dwelling has been provided in accordance with details to be submitted to and approved in writing by the Local Planning Authority.

Reason: To ensure the refuse collection bins do not cause a hazard or obstruction to the highway or parking area.
8) Prior to the occupation of the dwelling hereby approved, a scheme for the provision of waste receptacles for the dwelling shall be submitted to and agreed in writing by the Local Planning Authority. The receptacles shall be provided before occupation takes place.

Reason: In the interest of residential amenity and to reduce waste generation in accordance with the Councils's Minerals and Waste Local Plan 2014, Policy WSP5 and the adopted SPD "Managing Waste in New Developments" (2006).
9) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
10) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
11) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers; CBC-001, CBC-002.

Reason: To identify the approved plan/s and to avoid doubt.
