Conditions or Reasons for Planning Application - CB/23/01952/VOC
Conditions or Reasons:
1) The planting and landscaping scheme shown on approved Drawing No. JS-2023/003/rev. D shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season shall mean the period from October to March). The trees, shrubs and grass shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season with others of a similar size and species.

Reason: To ensure an acceptable standard of landscaping (Sections 12 & 15, NPPF)
2) No development hereby permitted shall take place except in accordance with the terms and conditions of the Council's Organisational Licence (WML-OR112, or a "Further Licence") and with the proposals detailed in plan "61316 Dunton Lane, Biggleswade: Impact PLa for great crested newt District Licensing (Version 2), dated 17th May 2023.

Reason:

In order to ensure that adverse impacts on great crested newts are adequately mitigated and to ensure that site works are delivered in full compliance with the organisational licence (WML-OR112, or a "Further Licence"), section 15 of the NPPF, Circular 06/2005 and the Natural Environment and Rural Communities Act 2006.
3) The development shall not be brought into use before the junction and visibility splays have been constructed in accordance with the approved drawing no. PL01 Revision A. The required vision splays shown on approved drawing PL01 revision A shall for the perpetuity of the development remain free of any obstruction to visibility.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises and to provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it in accordance with Policy T2 of the Central Bedfordshire Local Plan (2021)
4) The development shall not be brought into use before details of the arrangements for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway have been submitted to and approved in writing by the Local Planning Authority.

Reason: To avoid surface water from the site being discharged into the highway so as to safeguard the interest of highway safety in accordance with Policy CC5 of the Central Bedfordshire Local Plan (2021)
5) The development shall not be brought into use before any existing access within the frontage of the land to be developed, not incorporated in the access hereby approved, shall be closed in a manner to the Local Planning Authority's written approval and constructed in accordance with the approved details.

Reason: In the interest of road safety and to reduce the number of points at which traffic will enter and leave the public highway in accordance with Policy T2 of the Central Bedfordshire Local Plan (2021)
6) The vehicular access into the compound, parking, surfacing and turning area shown on the approved drawing no.JS-2023/003/ rev D shall be completed in advance of the first use of the development.

Reason: To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate access arrangements at all times Policy T2 of the Central Bedfordshire Local Plan (2021)
7) The development shall not be brought into use before a full height kerb (125mm) has been provided on the south side of the carriageway, opposite the junction, measuring 15.0m either side of the centre line of the junction.

Reason: For the avoidance of doubt and to alleviate any degradation to the carriageway/verge from vehicles using the site in accordance with Policy T2 of the Central Bedfordshire Local Plan (2021)
8) The building shall only be used for the storage of potatoes and associated farming machinery.

Reason: To ensure that the use of the building is appropriate for its location and is not used in ways that would be more appropriate within an urban area in accordance with Policies SP7 and HQ1 of the Central Bedfordshire Local Plan (2021)
9) Any planting (trees and shrubs) shall be planted 1 metre into the site measured from the highway boundary.

Reason

To ensure adequate visibility splays are maintained along the frontage of the site and to avoid enroachment and to allow pass and re-pass onto the public highway (Policy T2, Central Bedfordshire Local Plan, 2021)
10) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the following plans: JS-2023/003/ rev D; PL-04/A; Un-numbered site location plan; 1056912/01; 1056912/03; 1056912/04; 1056912/02 rev C; SP01 rev A and PL01/ rev A; Great Crested Newts Impact Plan ref: 61316 Dunton Lane, Biggleswade, Version 2, dated 17th May 2023.

Reason: To identify the approved plan/s and to avoid doubt.
