Conditions or Reasons for Planning Application - CB/23/01962/VOC
Conditions or Reasons:
1) Prior to the first occupation of the development hereby approved the scheme for the provision of fire hydrants shall be installed as approved under ref: 23/03550/DOC on the 03.05.24. Thereafter the fire hydrant(s) shall be retained as approved in perpetuity.

Reason: In the interests of fire safety and providing safe and accessible developments.

2) The development hereby approved shall be built in accordance with the final finished floor levels of the dwellings as shown on plan no LAND1 Rev B4 unless otherwise agreed in writing by the Local Planning Authority.
Reason: To ensure that an acceptable relationship results between the new development and adjacent buildings and public areas.

3) The surface water drainage details shown within Flood Risk Assessment GeoSmart (01.02.2022) (Reference 73425.01R6) and Drgs 73425.04 101 P07 and 73425.04 100 P08, and document FloodSmart Plus Technical Statement by GeoSmart Ltd, referenced 73425.00.01 dated September 2023, submitted to manage surface water runoff from the development within the red and blue land shall be implemented and maintained as approved prior to completion of the development and thereafter retained. Any variation to the connections and controls indicated on the approved drawings which may be necessary at the time of construction would require the resubmission of those details to the Local Planning Authority for approval.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site, in accordance with para 173 and 175 of the NPPF and its supporting technical guidance.
4) All ecological measures and/or works shall be carried out in accordance with the details contained in the Ecological Enhancement Strategy dated December 2021 as submitted and agreed in principle with the local planning authority and shall be retained thereafter.

Reason: To ensure development is ecologically sensitive and secures biodiversity enhancements in accordance with the National Planning Policy Framework.
5) The planting and landscaping scheme including hard boundary treatment shown on approved Drawing LAND1 B4 and Landscaping, Ecology Materials, Fencing and Planting Statement shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season shall mean the period from October to March). The trees, shrubs and grass shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season with others of a similar size and species.

Reason: To ensure an acceptable standard of landscaping and flood management.

6) The development hereby permitted will be constructed in Bromley Red Multi Brick manufactured by Vandersanden, SAHTAS handmade Multi red clay peg roof tiles,upvcdoors, windows and guttering to match the existing dwellings No.1-4 Cookes Meadowunless otherwise agreed in writing with the Local Planning Authority.

Reason: To control the appearance of the building in the interests of the visual amenitiesof the locality.(Section 12, NPPF)
7) No building shall be occupied until the junction of the proposed vehicular access with the highway has been constructed in accordance with the approved details.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
8) Before the premises are occupied all on site vehicular areas shall be surfaced and drained in accordance with the details approved under ref: 23/03550/DOC on the 03.05.24. The permeable paving as approved shall remain on site for the perpetuity of the development unless agreed in writing by the Local Planning Authority.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits
9) Prior to the occupation of any dwelling the refuse collection points shall be fully implemented as approved under ref: 23/03550/DOC on the 03.05.24 and shall be retained thereafter.

Reason: In the interest of amenity and in order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
10) The scheme for the secure and covered parking of cycles on the site calculated at one cycle parking space per bedroom and 2 short stay spaces per unit, shall be fully implemented before the development is first occupied or brought into use and thereafter retained for this purpose.

Reason: To ensure the provision of adequate cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable
modes of transport.
11) Prior to occupation, the proposed development shall be carried out and completed in all respects in accordance with the access siting and layout illustrated on the approved drawing no. SP1 rev D and defined by this permission and, notwithstanding the provision of the Town and Country Planning General Permitted Development Order 2015, (or any Order revoking or re-enacting that Order) there shall be no variation without the prior approval in writing of the Local Planning Authority.

Reason: To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and
appropriate access arrangements at all times.
12) The fence between plot 11 and plot 14 as indicated on the approved plan LAND1 rev B4 shall remain at a height of 600mm above the adjoining footway level for 1.8m into the site measured from the highway boundary unless otherwise agreed in writing by the local planning authority.

Reason: To provide adequate driver/pedestrian intervisibility at the access of plot 14
13) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
14) Prior to the occupation of the dwellings the electric vehicle charging points shown on drg LAND1 Rev B4 and EVCP specification shall be completed in accordance with the approved details and thereafter retained.

Reason: To assist with the transition to low-emission vehicles in line with Policy T5 of the Central Bedfordshire Council Local Plan 2021
15) All dwellings hereby approved must comply with the water efficiency standard of 110 litres per person per day as detailed by Regulation 36(2)(b) of Part G of Schedule 1 and Regulation 36 to the Building Regulations 2010 (as amended).

Reason: To ensure the efficient use of water in accordance with Policy CC1 of the Central Bedfordshire Local Plan (2021) and the objectives of sustainability set out in the NPPF (2021).
16) Any contamination that is found during the course of construction of the approved development that was not previously identified shall be reported immediately to the local planning authority. Development on the part of the site affected shall be suspended and a risk assessment carried out and submitted to, and approved in writing by, the local planning authority. Where unacceptable risks are found remediation and verification schemes shall be submitted to and approved in writing by the local planning authority. These approved schemes shall be carried out before the development is resumed or continued.

Reason: To ensure that any contamination which exists on the site is identified and properly dealt with in the interests of the residential amenity of the future occupiers of the site and of the surrounding area. (Section 12, NPPF)
17) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers:
