Conditions or Reasons for Planning Application - CB/23/02538/FULL
Conditions or Reasons:
1) The removal of a significant amount of hedgerow and trees would cause harm to the openness of the Green Belt. Furthermore, due to the removal of the hedgerow and trees, it is considered that the proposal would fail to preserve the setting and special character of historic towns, one of the main five purposes of the Green belt, in direct conflict with Section 13 of the NPPF, Policy SP4 of the Central Bedfordshire Local Plan and Section 11 of the Central Bedfordshire Design Guide.
2) It is considered due to the significant scale of the removal of hedgerow, trees and the protected Oak tree, it would have a detrimental impact on the streetscene and caharacter and appearance of the area. The proposal would result in less than substantial harm to the Aspley Guise Conservation Area. In accordance with paragraph 202 of Section 16 of the NPPF, the public benefits of the proposal would not outweigh the identified harm. The proposal is therefore contrary to Section 16 of the NPPF and Policy HE3 of the Central Bedfordshire Local Plan (2021), and the principles of good design as set out within sections 12 and 16 of the National Planning Policy Framework, Policies HQ1 and HE3 of the Central Bedfordshire Local Plan (2021) and Central Bedfordshire Design Guide.
3) Insufficient justification has been provided to the removal of the hedgerow and the protected Oak Tree, it is considered that the proposal would be inappropriate development that is likely to have a negative impact upon the sustainable relationship with the treescape character of the area and its protected trees. As such, the proposal is considered to be contrary to Policies EE4 and HQ1 of the Central Bedfordshire Local Plan (2021).
