Conditions or Reasons for Planning Application - CB/23/02700/FULL
Conditions or Reasons:
1) The proposed development would give rise to a level of noise and disturbance that would have a significantly harmful impact upon the amenity enjoyed by neighbouring occupiers surrounding the site and the noise generated would not be able to be sufficiently mitigated by the proposed 1.8m high acoustic fencing. As such, the proposal is considered to fail to safeguard the amenity of neighbouring occupiers, contrary to Sections 12 and 15 of the National Planning Policy Framework, Policies HQ1 and CC8 of the Central Bedfordshire Local Plan and the Central Bedfordshire Design Guide.
2) Insufficient information has been provided regarding artificial lighting, smoke and odour in order to allow the Local Planning Authority to determine whether the proposal would result in any harm to neighbouring amenity in terms of light disturbance and odour and smoke impacts. As such, in the absence of sufficient details, the proposal could have a potentially harmful impact upon neighbouring amenity, contrary to Section 12 and 15 of the NPPF, Policies HQ1 and CC8 of the Central Bedfordshire Local Plan and the Central Bedfordshire Design Guide.
3) By reason of its scale, height and unsympathetic design, the pergola structures and acoustic fencing would appear incongruous and result in visual harm to the character and appearance of the surrounding area. The proposal would also fail to preserve or enhance the character and appearance of the Conservation Area, amounting to less than substantial harm to the significance of the designated heritage asset that would not be outweighed by public benefits. As such, the proposal would be contrary to Sections 12 and 16 of the National Planning Policy Framework, Policies HQ1 and HE3 of the Central Bedfordshire Local Plan, Section 72(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990 and the Central Bedfordshire Design Guide.
