Conditions or Reasons for Planning Application - CB/23/03002/VOC
Conditions or Reasons:
1) The development hereby permitted shall begin not later than 26 July 2026.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall be carried out in accordance with the following approved plans:

Site Location and Block Plan 2022/1016/06
Plot 1 Plans and Elevations 2022/1016/02D
Plot 1 Garage Plans and Elevations 2022/1016/05C
Plot 2 Plans and Elevations 2022/1016/03C
Plot 2 Garage and Store Plans and Elevations 2022/1016/04C
Arboricultural Implications Plan 4536.Piglings.MH.AIP Rev C
Tree Protection Plan 4536.Piglings.MH.TPP Rev C.
Reason: To identify the approved plan/s and to avoid doubt.
3) The external materials for the development shall be carried out in accordance with those detailed in application CB/23/02587/DOC - Condition 3, approved on 29.08.2023.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality. (Section 12, NPPF)
4) The landscaping scheme for the development shall be carried out in accordance with that detailed in application CB/23/02789/DOC - Condition 4, approved on 29.09.2023.

Reason: To ensure an acceptable standard of landscaping. (Sections 12 and 15, NPPF)
5) Prior to first occupation of the development hereby permitted, details of any external lighting to be installed on the site shall have been submitted to and approved in writing by the local planning authority and installed in accordance with the approved details and retained in that manner thereafter.

Reason: To protect the visual amenity of the site and its surrounding area and to prevent the woodland edge of Nunswood County Wildlife Site from being affected by light spill. (Section 12 and 15, NPPF)
6) The developement hereby approved shall be carried out in accordance with the Samsara Ecological Enhancement Strategy 174 version 1 Dated August 2023 as submitted and approved with this application.

Reason: To ensure all ecological impacts from the development are taken into account and mitigated (Section 15, NPPF)
7) Prior to first occupation of the development hereby permitted, the turning space for vehicles illustrated on the approved Plan no. 2022/1016/06 shall be constructed and retained for the use of manoeuvring vehicles thereafter.

Reason: To enable vehicles to draw off, park and turn outside the highway limits thereby avoiding the reversing of vehicles on to the highway. (Section 9, NPPF)
8) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 1995, or any amendments thereto, the parking provision on the site, including the visitor parking space, shall not be used for any purpose, other than as parking provision unless permission has been granted by the local planning authority on an application made for that purpose.

Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users and cause obstruction to the manoeuvring of vehicles within the site leading to vehicles having to reverse a substantial length prior to turning. (Section 9, NPPF)
9) The scheme for the charging of electric and ultra-low emission vehicles shall be carried out in accordance with that detailed in application CB/23/02789/DOC - Condition 9, approved on 29.09.2023.

Reason: To assist with the transition to low-emission vehicles in line with Policy T5 of the Central Bedfordshire Local Plan (2021) and the National Planning Policy Framework 2023.
10) Notwithstanding the provisions of Part 1, Class A of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions to the building hereby permitted at Plot 1, as indicated on Plan 2022/1016/06, shall be carried out without the grant of further specific planning permission from the local planning authority.

Reason: To control the external appearance of the building/s in the interests of the amenities of the area. (Section 12, NPPF)
11) Notwithstanding the provisions of Part 1 Class E of Schedule 2 to the Town and Country (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no buildings or other structures shall be erected or constructed within the curtilage of the property at Plot 1, as indicated on Plan 2022/1016/06, without the grant of further specific planning permission from the local planning authority.

Reason: To control the development in the interests of the visual amenity of the area. (Section 12, NPPF)
12) Notwithstanding the provisions of Part 2 Class A of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no fences, gates, walls or other means of enclosure shall be erected within the curtilage of the property at Plot 1, as indicated on Plan 2022/1016/06, without the grant of further specific planning permission from the local planning authority.

Reason: To control the development in the interests of the rural amenity of the area. (Section 12, NPPF)
13) The development shall be undertaken in full accordance with the Council's adopted Environmental Code of Practice and Construction Code of Practice for Developers and Contractors.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties and the impact of development on existing trees, landscape features and biodiversity (Sections 12 and 15, NPPF)
