Conditions or Reasons for Planning Application - CB/23/03026/OUT
Conditions or Reasons:
1) The application site lies outside of the Shillington Settlement Envelope and is within the Conservation Area and open countryside. The proposed development would erode the valued open space, urbanising a significant portion of the application site and thereby harmfully altering the rural character of the area and significance of the designated heritage asset. As such, the proposal would result in less than substantial harm to the setting of the Conservation Area and historic village core. The adverse impacts to the rural setting of the Conservation Area would significantly outweigh the limited public benefits of the scheme, and as such the proposed development would conflict with Policies HE3, EE5 and HQ1 of the Central Bedfordshire Local Plan, as well as Section 16 of the National Planning Policy Framework.
2) The proposed development would result in a significant urbanisation of the semi-rural landscape which lies beyond the settlement envelope of Shillington, and therefore within the open countryside. The development would result encroachment of the built form of Shillington into the open countryside, and would therefore cause harm to character and appearance of the area, and would conflict with Policies SP7, EE5, and HQ1 of the Central Bedfordshire Local Plan and the National Planning Policy Framework.
3) The proposed development, specifically proposed plots 1 and 8 would result in an unacceptable loss of outlook and overbearing impact upon the residents of 1 Bells Close and 5 Preslent Close. The proposed plots conflict with the design guidance contained with the Central Bedfordshire Design Guide due to their proximity and poor relationship with these neighbouring properties. As such, the proposal would conflict with Policy HQ1 of the Local Plan and the National Planning Policy Framework.
4) The existing site is private semi rural shrubland, which makes a positive contribution to biodiversity. The proposed development would result in the loss of a large parcel of undeveloped land considered to form open countryside. Due to a lack of information provided with the application, the proposed development has not demonstrated there will be a net gain in biodiversity. As such, the proposal conflicts with Policy EE2 of the Central Bedfordshire Local Plan and the National Planning Policy Framework.
5) In the absence of a completed legal agreement securing a management scheme which details the future ownership, management and maintenance of the site, the proposed development would conflict with Policy EE13 of the Central Bedfordshire Local Plan, and Central Bedfordshire Leisure Strategy.
