Conditions or Reasons for Planning Application - CB/23/03042/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Notwithstanding the changes of use permitted within Part 3 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification), the development hereby approved shall only be used for the provision of residential accommodation and care to children in need of care within Class C2 of the Town and Country Planning (Use Classes) Order 1987 (or any Order revoking or re-enacting that Order with or without modification) only, and for no other purpose within C2.

Reason: To exclude the provisions of the said Use Classes Order and thereby ensure the Local Planning Authority retains full control of the future use of the land/buildings in view of the special circumstances of the case. (Section 12, NPPF)
3) No more than five children in care shall reside at the home hereby approved at any one time, unless otherwise agreed in writing with the Local Planning Authority.

Reason

In the interest of minimising the general noise and disturbance generated by the proposed use in the interest of the residential amenity of the area, pursuant to Policy HQ1 of the Central Bedfordshire Local Plan (2023)
4) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015, or any amendments thereto, the parking provision on the site, as shown on approved plan ref: Sheet 02 REV A, shall not be used for any purpose other than as parking provision, unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason

To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users, pursuant to Policies T2 and T3 of the Central Bedfordshire Local Plan (2021) and Section 9 of the NPPF (2023)
5) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 01 Rev B, Sheet 02 REV A and CBC001.

Reason: To identify the approved plans and to avoid doubt.
