Conditions or Reasons for Planning Application - CB/23/03130/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to development and the installation of tree protection barriers, tree removal shall be confined to the felling of the "U" Category tree T09 (Rowan), as shown on the "Tree Survey and Constraints Plan", of the supporting document "BS5837 : 2012 Arboricultural Survey" (Document Ref. No. 3030.011.ENZ.XX.00.RP.AR.45.101 Rev PL01), and in accordance with Section 4.1 "Tree Removal" of the supporting document "BS 5837 : 2012 "Arboricultural Impact Assessment and Arboricultural Method Statement" (Document Ref. 3030.011.ENZ.XX.00.RP.AR.45.102 Rev. PL02).

REASON
To ensure that only the decayed tree identified as requiring removal on account of its poor condition is undertaken, thereby avoiding unjustified or unnecessary tree removal, which would otherwise result in the development imposing adverse impact on visual amenity, site screening and biodiversity on its site surrounds.
3) Prior to development, and following permitted tree removal, all tree protection barriers shall be constructed and positioned in strict accordance with Section 4.2 "Protective Barrier", Appendix 1 "Tree Protection Plan" (Drawing No. 3030.011.ENZ.XX.00.DR.AR.45.102 Rev PL02) and Appendix 2 "Protective barrier to BS 5837 : 2012" of the supporting document "BS 5837 : 2012 "Arboricultural Impact Assessment and Arboricultural Method Statement" (Document Ref. 3030.011.ENZ.XX.00.RP.AR.45.102 Rev. PL02).

REASON
To establish a secure Construction Exclusion Zone around the designated Root Protection Areas of all retained trees, so as to safeguard their health, anchorage, amenity and biodiversity value from potential development damage.
4) Throughout the course of development, all working methodology shall adhere to the requirements stipulated in Section 4.3 "Removal of hard landscape", Section 4.4 "Installation of charger infrastructure", Section 4.5 "No-dig construction methodology for new hard surfaces", Section 4.6 "Installation of Utility Apparatus", Appendix 1 "Tree Protection Plan" (Drawing No. 3030.011.ENZ.XX.00.DR.AR.45.102 Rev PL02) and Appendix 3 "NJUG Tree Protection Zone", of the supporting document "BS 5837 : 2012 "Arboricultural Impact Assessment and Arboricultural Method Statement" (Document Ref. 3030.011.ENZ.XX.00.RP.AR.45.102 Rev. PL02).

REASON
To ensure that all working methodology conforms to the requirements of good arboricultural practice, and adheres to that specified in the Arboricultural Method Statement.
5) The planting and landscaping scheme shown on approved Drawing No.3030.011.ENZ.XX.00.DR.L.45.101 PL03 shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season shall mean the period from October to March). The trees, shrubs and grass shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season with others of a similar size and species.

Reason: To ensure an acceptable standard of landscaping and Biodiversity Net Gain.

6) The ecological improvements as shown on plan number CRM3030011-ENZ-XX-XX-DR-Z-0003 P01 shall be installed prior to the first use of the development and shall be retained in perpetuity.

To provide ecological improvements around the site
7) Before the premises are occupied all on site vehicular areas shall be surfaced in a stable and durable materials in accordance with details to be approved in writing by the Local Planning Authority. Arrangements shall be made for surface water drainage from the site to soak away within the site so that it does not discharge into the highway or into the main drainage system.

Reason
To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits
8) The cumulative external sound level (Rating Level) emitted from the premises including patrons, plant, machinery or equipment at the development hereby approved shall be lower than the lowest existing background sound level order to prevent any adverse impact. The assessment shall be made in accordance with BS4142:2014 at the nearest and/or most affected noise sensitive premises, with all machinery operating together at maximum capacity.

Reason: To ensure an acceptable level of noise for the neighbouring residents (Policy CC8 and HQ1 of the CBC Local Plan)
9) Notwithstanding the details submitted, the proposed lighting scheme hereby approved shall be warm in appearance and not exceed a temperature of 3000 kelvin (K), unless otherwise agreed in writing by the Local Planning Authority.

Reason: To ensure an acceptable level of lighting for both the open countryside location and the neighbouring residents (Policy HQ1 and CC8 of the CBC Local Plan).
10) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
11) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 3030.011.ENZ.XX.00.DR.L.45.101 PL03, Noise Impact Assessment dated July 2023, CRM.3030.011.PL.D.001, CRM.3030.011.PL.D.002, CRM.3030.011.PL.D.003, CRM.3030.011.PL.D.004, CRM.3030.011.PL.D.004a, CRM.3030.011.PL.D.005, CRM.3030.011.PL.D.005a, CRM.3030.011.PL.D.006, CRM.3030.011.PL.D.101, CRM.3030.011.PL.D.102, CRM.3030.011.PL.D.103, CRM.3030.011.PL.D.104, CRM.3030.011.PL.D.105, CRM.3030.011.PL.D.106, CRM3030011-ENZ-XX-XX-DR-Z-0003 P01, Arboricultural Survey dated July 2023, Arbiocultural Method Statement - 3030.011.ENZ.XX.00.RP.AR.45.102 and Ecological Impact Assessment - CRM.3030.011.EC.R.001.

Reason: To identify the approved plan/s and to avoid doubt.
