Conditions or Reasons for Planning Application - CB/23/03246/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Notwithstanding the changes of use permitted within Part 3 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification), the development hereby approved shall only be used for the provision of residential accommodation as a care home within Class C2 of the Town and Country Planning (Use Classes) Order 1987 (or any Order revoking or re-enacting that Order with or without modification) only, and for no other purpose within C2.

Reason: To exclude the provisions of the said Use Classes Order and thereby ensure the Local Planning Authority retains full control of the future use of the land/buildings in view of the special circumstances of the case.
3) No more than six persons in care shall reside at the home hereby approved at any one time, unless otherwise agreed in writing with the Local Planning Authority.

Reason

In the interest of minimising the general noise and disturbance generated by the proposed use in the interest of the residential amenity of the area, and to ensure adequate parking levels, pursuant to Policies HQ1 and T2 of the Central Bedfordshire Local Plan (2023)
4) Before the development is brought into use, the parking spaces as shown on plan ref. RPD_HAMPDEN_030123_02 Rev B shall be provided and retained in perpetuity, and the parking spaces, turning area and access shall remain unobstructed at all times.

Reason: To provide adequate parking and appropriate access arrangements at all times, in accordance with Policies T2 and T3 of the Central Bedfordshire Local Plan (2021).
5) Before development begins, a scheme for the secure and covered parking of cycles on the site (including the internal dimensions of the cycle parking area, stands/brackets to be used and access thereto) shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be fully implemented before the development is first occupied or brought into use and thereafter retained for this purpose.

Reason: To ensure the provision of adequate cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport, in accordance with Policy T3 of the Central Bedfordshire Local Plan (2021).
6) Prior to the first use of the proposed development, a management plan shall be submitted to and approved in writing by the Local Planning Authority, and shall include, but not be limited to:

- the number of staff on site at any one time
- the timing of shift patterns for staff
- the contact details of a site manager
- waste collection details
- measures to manage parking demand
- measures to promote sustainable transport methods
- details of how visitor appointments are managed

The management of the facility shall be implemented in accordance with those details and retained in perpetuity, unless otherwise agreed in writing.

Reason: To protect the amenity of neighbouring residents and to ensure that there is adequate parking, in accordance with Policies HQ1, CC8 and T3 of the Central Bedfordshire Local Plan 2021.
7) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers RPD_HAMPDEN_030123_02 Rev B and RPD_HAMPDEN_031023_01

Reason: To identify the approved plan/s and to avoid doubt.
