Conditions or Reasons for Planning Application - CB/23/03291/RM
Conditions or Reasons:
1) Development shall not begin later than two years from the date of this decision.

Reason: To comply with Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to the first use of the southern access from Station Road for construction access associated with the proposed dwellings, the parking provision and hard surfacing for no. 76 Station Road shall be constructed in accordance with plan ref. 1102 Rev B. Thereafter, the parking provision and permeable surfacing shall be retained unless otherwise agreed in writing by the Local Planning Authority.

Reason: For the avoidance of doubt and to provide adequate replacement parking provision for the existing dwelling, in accordance with Policy T3 of the Central Bedfordshire Local Plan (2021).
3) Prior to the occupation of the first dwelling, details of the charging points for electric and ultra-low emission vehicles, to include at least one or more active EV charging point per dwelling, shall be submitted to and approved in writing by the Local Planning Authority. The development shall be completed in accordance with these approved details.

Reason: To secure the design and siting of the electrical vehicle charging, in accordance with Policy HQ1 of the Central Bedfordshire Council Local Plan 2021
4) Prior to the occupation of the first dwelling, a scheme for the secure and covered parking of cycles on the site (including the internal dimensions of the cycle parking area, stands/brackets to be used and access thereto), calculated at one cycle parking space per bedroom for residents and one cycle parking space for visitors, shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be fully implemented before the development is first occupied or brought into use and thereafter retained for this purpose.

Reason: To ensure the provision of adequate cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport, in accordance with Policy T3 of the Central Bedfordshire Local Plan (2021).
5) Prior to the occupation of the first dwelling, details of hard landscaping and boundary treatment (including walls, fences or other means of enclosure) shall be submitted to an improved in writing by the Local Planning Authority, and shall be implemented in accordance with those details.

Reason: In the interest of the amenity of the surrounding area and of neighbouring occupiers, in accordance with Policy HQ1 of the Central Bedfordshire Local Plan (2021).
6) The soft landscaping shall be carried out in accordance with the details provided on plan ref. 7566.PP.1.0 Rev C prior to or during the first planting season (October-March) following the occupation of the first dwelling.

Reaosn: To ensure that an acceptable level of landscaping is provided, in the interest of amenity and biodiversity enhancements, in accordance with Policies EE2, EE4 and HQ1 of the Central Bedfordshire Local Plan (2021).
7) Notwithstanding the details set out on the soft landscaping plan ref. 7566.PP.1.0 Rev C, the ecological enhancements shall be implemented in accordance with the details set out in the Ecological Enhancement Scheme (Cherryfield Ecology, 06.10.2023) prior to or during the first planting season (October-March) following the occupation of the first dwelling.

Reason: To ensure adequate net gains in biodiversity, in accordance with Policy EE2 of the Central Bedfordshire Local Plan (2021).
8) Other than the in site footway, prior to the occupation of the first dwelling the proposed development shall be carried out and completed in all respects in accordance with the access siting and layout, pedestrian visibility splays, turning areas, surfacing of vehicular areas visitor parking layout, refuse collection point as shown on the approved plan Nos. 1101, 1102, 1103 and defined by this permission and, notwithstanding the provision of the Town and Country Planning General Permitted Development Order 2015, (or any Order revoking or re-enacting that Order) there shall be no variation without the prior approval in writing of the Local Planning Authority.

Reason: To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate access arrangements at all times, in accordance with Policies T2 and T3 of the Central Bedfordshire Local Plan (2021).
9) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the parking provision, including visitor parking provision, on the site shall not be used for any purpose, other than as parking provision unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users and obstruct the manoeuvring areas within the site, in accordance with Policy T3 of the Central Bedfordshire Local Plan (2021).
10) The footway indicated on the north side of the proposed access within the site and east side of the access at the turning head should be omitted from the layout or details of a revised layout should be submitted to and approved in writing by the local planning authority before development commences, with approved details implemented prior to occupation

Reason: To remove / or provide a workable footway, with unobstructed ease of access for pedestrians, in the interest of highway safety and good design, in accordance with Policies T2 and HQ1 of the Central Bedfordshire Local Plan (2021).
11) There shall be no vegetative planting other than grass on the south side of the proposed access for 46.0m into the site measured from the highway boundary

Reason: For the avoidance of doubt and to alleviate encroachment of vegetational growth into the access which would reduce the access width, in the interest of highway safety in accordance with Policy T2 of the Central Bedfordshire Local Plan (2021).
12) Prior to the occupation of the first dwelling, the junction of the proposed vehicular access with the highway shall be constructed in accordance with the approved details, including the provision of 2.4m x 43.0m visibility splays.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises, in accordance with Policy T2 of the Central Bedfordshire Local Plan (2021).
13) The dwellings hereby permitted shall be constructed in accordance with the materials schedule as shown on plan refs 1301 and 1302, unless otherwise agreed in writing by the Local Planning Authority.

Reason: In the interest of securing good design and of amenity, in accordance with Policy HQ1 of the Central Bedfordshire Local Plan (2021).
14) The proposed development shall be carried out in accordance with the ground, ridge and slab levels as shown on plan refs. 1101 Rev B; 1102 Rev B; and 1401.

Reason: To ensure that an acceptable relationship results between the new development and adjacent buildings and public areas, in the interest of the amenity of the surrounding area and neighbouring occupiers, in accordance with Policy HQ1 of the Central Bedfordshire Local Plan (2021).
15) No gates shall be erected within the access unless otherwise agreed in writing by the Local Planning Authority.

Reason: So that the access and turning areas remains free of obstruction to all traffic using the site to enable vehicles to leave in forward gear and to not obstruct the highway, in accordance with Policy T2 of the Central Bedfordshire Local Plan (2021).
16) Other than the first floor southern elevation windows on Plots 3 and 5, no further windows or other openings at first floor shall be formed in the northern or southern elevations of the proposed dwellings.

Reason: To safeguard the privacy of occupiers of adjoining properties and future occupiers, in accordance with Policy HQ1 of the Central Bedfordshire Local Plan (2021).
17) During construction all trees and hedgerows not shown to be removed shall be protected in accordance with the details outlined in the Tree Survey Report (RGA, Robert C Yates, October 2023).

Reason: In the interest of protecting landscape features which are of amenity and ecological value, in accordance with Policies EE2 and EE4 of the Central Bedfordshire Local Plan (2021).
18) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 7566.PP.1.0 Rev C; 1101 Rev B; 1102 Rev B; 1103 Rev B; 1001; 1201; 1202; 1203; 1301; 1302; 1401

Reason: To identify the approved plan/s and to avoid doubt.
