Conditions or Reasons for Planning Application - CB/23/03652/OUT
Conditions or Reasons:
1) The proposed development would result in the partial loss of a Local Green Space (LGS12 - Land behind Cobbitts Road), resulting in the intrusion and urbanisation of land which has been identified as being an important open space, which provides a 'gateway' into Maulden, and is key to the 'sense of place', rural vernacular and local character of the area. The harm demonstrated is not clearly outweighed by other considerations, nor have very special circumstances been demonstrated. The development is therefore contrary to Policies M3 and M8 of the Maulden Neighbourhood Plan and Policies HQ1 and EE5 of the Central Bedfordshire Local Plan (2021).
2) Insufficient information has been provided to determine the impact upon species of principal importance or to present appropriate mitigation and compensatory measures. In addition to this, the full biodiversity net gains calculations have not been provided, in order to demonstrate that biodiversity net gains could be provided from the development. The proposal cannot be said to ensure the safeguarding of species or satisfactory assurance that the proposal would provide net gains for biodiversity, contrary to Policies EE2 and EE3 of the Central Bedfordshire Local Plan, Policy M6 of the Maulden Neighbourhood Plan and Section 15 of the National Planning Policy Framework (2023)
3) Insufficient information, which would be required in the form of a result of a trial trench evaluation, has been submitted with this application to demonstrate that there would be no harm to archaeological remains which would represent heritage assets, contrary to Policy HE1 of the Central Bedfordshire Local Plan (2021), Policy M3 of the Maulden Neighbourhood Plan and Section 16 of the National Planning Policy Framework (2023).
