Conditions or Reasons for Planning Application - CB/23/03775/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to commencement of above ground works, details of the materials to be used for the external walls and roofs of the development hereby approved have been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality. (Section 12, NPPF)
3) The development hereby approved shall be completed in full accordance with the planting and soft landscaping schemes (including boundary treatments) shown on approved drawings reference;

The landscaping shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season shall mean the period from October to March). The trees, shrubs and grass shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season with others of a similar size and species and in accordance with the Landscape Management and Maintenance Plan (reference PRI24335 Man rev. F) hereby approved.

Reason: To ensure an acceptable standard of landscaping. (CBCLP HQ1 and Sections 12 & 15, NPPF)
4) No above ground work shall take place until a hard landscaping scheme, has been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.

Reason: To ensure an acceptable standard of hard landscaping. (Sections 12 and 15 NPPF)
5) No development shall commence until a detailed surface water drainage scheme, to manage surface water runoff from the development for up to and including the 1 in 100 year event (+40%CC+10%UC), via attenuated discharge into existing watercourse, and a proposed maintenance and management plan for the scheme has been submitted to and approved in writing by the Local Planning Authority. The final detailed design shall be based on the 'BE5546-5PD The Field Bidwell FRA 22.11.23' and DEFRAs non-statutory technical standards for sustainable drainage systems (March 2018) and shall be implemented and maintained as approved. Maintenance is to be identified for all drainage features and will ensure the system functions as designed for the lifetime of the development. Any variation to the connections and controls indicated on the approved drawing which may be necessary at the time of construction would require the resubmission of those details to the Local Planning Authority for approval. The discharge rate from thedevelopment will be limited to the equivalent 1 in 1 year rate, or an appropriate rate as agreed by the Bedford Group of Internal Drainage Boards.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site, in accordance with CBC Local policy CC3 to CC5 and NPPF Paras 159 to 169 Inclusive of foot notes 54 to 56 and its supporting technical guidance.
6) Prior to the commencement of development, a scheme for the offsetting of biodiversity impacts at the site, offsetting a total value of at least 0.13 credits and meeting the metric trading rules, shall be submitted to the Local Planning Authority and approved in writing. This should be supported by a biodiversity metric for the site, and appropriate legal agreements to guarantee third party delivery of ongoing habitat management requirements.

The Offsetting scheme shall include:
i. Identification of receptor site or sites
ii. Details of the offsetting requirements of the development in accordance with current Defra biodiversity metric, which has been calculated at at least 0.13 Biodiversity Units;
iii. The provision of evidence of arrangements to secure the delivery of offsetting measures, including a timetable of delivery; and
iv. A management and monitoring plan, to include for the provision and maintenance of the offsetting measures for a period of not less than 30 years from the commencement of the scheme. The management and monitoring plan is to include:
a. Description of all habitat(s) to be created/restored/enhanced within the scheme including expected management condition and total area;
b. Review of Ecological constraints;
c. Current soil conditions of any areas designated for habitat creation and detailing of what conditioning must occur to the soil prior to the commencement of habitat creation works (for example, lowering of soil pH via application of elemental sulfur);
d. Detailed design and working methods (management prescriptions) to achieve proposed habitats and management conditions, including extent and location or proposed works;
e. Type and source of materials to be used, including species list for all proposed planting and abundance of species within any proposed seed mix;
f. Identification of persons responsible for implementing the works;
g. A timetable of ecological monitoring to assess the success of all habitats creation/enhancement.

The offsetting scheme shall thereafter be implemented in accordance with the requirements of the approved scheme.

Reason: In the interests of securing a net-gain for biodiversity (Policy EE2, CBLP, Section 15, NPPF)
7) Tree removal undertaken in the course of this development shall be confined to that being shown on the "Tree Protection Plan" (Drawing No. TGA.2571.TPP.002A) of the supporting document "BS5837 : 2012 Arboricultural Impact Assessment" dated 10th August 2023 (Document Ref. TGA.2571.ArbImpactAssessment.rev A)

Reason: To prevent unnecessary or unjustified tree removal being carried out, thereby avoiding any detrimental impact on the local landscape, its visual amenity, site screening and biodiversity value.
8) Prior to development, all tree protection barriers shall be erected and positioned in accordance with Section 4 "Arboricultural Method Statement" and the "Tree Protection Plan" (Drawing No. TGA.2571.TPP.002A) of the supporting document "BS5837 : 2012 Arboricultural Impact Assessment" dated 10th August 2023 (Document Ref. TGA.2571.ArbImpactAssessment.rev A). The tree protection barriers shall then remain securely in position throughout the entire course of development works.

Reason:To maintain a secure Construction Exclusion Zone around the designated Root Protection Areas and existing canopy spread of retained trees, so as to maintain their health, anchorage, amenity, screening and biodiversity value.
9) Throughout the course of development, all construction methodology and working procedures shall conform to the requirements specified in Section 4 "Arboricultural Method Statement" and the "Tree Protection Plan" (Drawing No. TGA.2571.TPP.002A) of the supporting document "BS5837 : 2012 Arboricultural Impact Assessment" dated 10th August 2023 (Document Ref. TGA.2571.ArbImpactAssessment.rev A)

Reason: To ensure that trees are not damaged by construction operations, and that working methodology is carried out in accordance with good arboricultural practice.
10) No building shall be occupied until the junction of the proposed vehicular access with the highway has been constructed in accordance with the approved details.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises. (Policy T2, CBLP, Section 9, NPPF)
11) The proposed vehicular access shall be surfaced in bituminous or other similar durable material (not loose aggregate) as may be approved in writing by the Local Planning Authority for a distance of 5m into the site, measured from the highway boundary, before the premises are occupied. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety.(Policy T2, CBLP, Section 9, NPPF)
12) The turning space for vehicles illustrated on the approved Plan (No 23047 (D) 101 rev. D) shall be constructed before the development is first brought into use.

Reason: To enable vehicles to draw off, park and turn outside the highway limits thereby avoiding the reversing of vehicles on to the highway.(Policy T2, CBLP, Section 9, NPPF)
13) Development shall not commence until a scheme detailing provision for on site parking for construction workers and deliveries for the duration of the construction period has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented throughout the construction period.

Reason: To ensure adequate off street parking during construction in the interests of road safety. (Policy T2, CBLP, Section 9, NPPF)
14) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
15) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
16) The development hereby approved shall be completed in full accordance with the Sustainability Statement (Ref: 23185) by Low Carbon Box dated 18th October 2023 (Rev B - 17th November 2023)

Reason: In order to ensure the development is sustainable in terms of climate change and renewable energy. (Policy CC1, CBLP).
17) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 23047 (D) 097 rev. A 'Location Plan', 23047 (D) 110 '2 Bed Floor Plans - Proposed', 23047 (D) 115 '2 Bed Elevations - Proposed', 23047 (D) 120 '3 Bed Floor Plans - Proposed', 23047 (D) 125 '3 Bed Elevations - Proposed', 23047 (D) 099 rev. E 'Proposed Site Plan', 23047 (D) 100 rev. C 'Proposed Site Plan Coloured', 23047 (D) 101 rev. D 'Proposed Site Plan Coloured', 23047 (D) 102 rev. C 'Proposed Boundary Treatments Plan'.

Reason: To identify the approved plan/s and to avoid doubt.
