Conditions or Reasons for Planning Application - CB/23/03905/PAAD
Conditions or Reasons:
1) The development hereby granted prior approval shall be completed within three years from the date of this decision.

Reason: To comply with Paragraph Q.2 (3) of Class Q of Part 3 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (as amended).
2) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those in drawing numbers V23-105-P05_E, V23-105-P06_D, V23-105-P07_E, and V23-105-P08_E.

Reason: To safeguard the appearance of the completed development in the interests of the visual amenities of the locality.

3) Unless the Council agree in writing that a set extent of development must commence to enable compliance with this condition, no development shall commence until, a remediation method statement is submitted to and approved in writing by the Council. This statement shall detail any required remediation works and shall be designed to mitigate any remaining risks identified in the approved quantitative risk assessment. All works must be carried out in compliance with and by a competent person who conforms to Land Contamination Risk Assessment (LRCM) guides.

Reason: In order to protect human health and the environment and in accordance with paragraphs 189 and 190 of the NPPF.
4) Unless the Council agree in writing that a set extent of development must commence to enable compliance with this condition, no development shall commence until the approved remediation method statement has been carried out in full and a verification report confirming these works has been submitted to, and approved in writing, by the Council. This report shall include: details of the remediation works carried out; results of any verification sampling, testing or monitoring including the analysis of any imported soil; all waste management documentation showing the classification of waste, its treatment, movement and disposal; and the validation of gas membrane placement. If, during development, contamination not previously identified is found to be present at the site, the Council is to be informed immediately and no further development (unless otherwise agreed in writing by the Council) shall be carried out until a report indicating the nature of the contamination and how it is to be dealt with is submitted to, and agreed in writing by, the Council. Any required remediation shall be detailed in an amendment to the remediation statement and verification of these works included in the verification report. All works must be carried out in compliance with and by a competent person who conforms to Land Contamination Risk Assessment (LRCM) guides.

5) Prior to use of the development, details of external artificial lighting shall be submitted to and approved in writing by the Council. Lighting contours shall be submitted to demonstrate that the vertical illumination of neighbouring premises is in accordance with the recommendations of the Institution of Lighting Professionals in the 'Guidance Note 01/20: Guidance Notes for the Reduction of Obtrusive Light'. Details should also be submitted for approval of measures to minimise use of lighting and prevent glare and sky glow by correctly using, locating, aiming and shielding luminaires. Lighting colour shall be warm in appearance and not exceeding a temperature of 3000 kelvin (K). Approved details shall be implemented prior to occupation of the development and thereafter be permanently retained

Reason: To protect the visual amenity of the site and its surrounding area.

6) The development hereby permitted shall not be commenced until a detail of the surface water drainage has been submitted to, and approved in writing by, the Local Planning Authority. The design shall be fully implemented and subsequently maintained, in accordance with the agreed design and maintenance arrangements. The scheme to be submitted shall include: (1) Plans and calculations showing sufficient disposal, storage and conveyance of surface water (up to and including for the 1in100 year event + a 40% allowance for climate change); (2) If proposing to discharge via infiltration, results of site-specific infiltration testing to support the design of infiltration devices (carried out in accordance with BRE 365); (4) if discharging to a sewer system, confirmation from the water company that connection is feasible and capacity is available; (5) details of the full design and layout of the surface water drainage scheme in its entirety and of the foul drainage arrangements; (6) Confirmation of the management and maintenance arrangements for the surface water drainage system in its entirety. The scheme shall subsequently be constructed and maintained as approved.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site, in accordance with para 167 of the NPPF and its supporting technical guidance.
7) This approval relates only to the details shown on the submitted plans, numbers V23-105-EX01_B Existing Site Plan, V23-105-P04_G Proposed Site Plan, V23-105-P05_E Plot 1 - Proposed Plans and Elevations, V23-105-P06_D Plot 2 - Proposed Plans and Elevation, V23-105-P07_E Plot 3 - Proposed Plans and Elevations, V23-105-P08_E Plot 4 and 5 - Proposed Plans and Elevations, V23-105-SLP02_C Site Location Plan, V23-105-EX03_A Barn 1 - Existing Floor Plans and Elevations, V23-105-EX04_A Barn 2 - Existing Floor Plans and Elevations, V23-105-EX05_A Barn 3 - Existing Floor Plans and Elevations, V23-105-EX06_A Barn 4 and 5 - Existing Floor Plans and Elevations.

Reason: To identify the approved plan/s and to avoid doubt.
