Conditions or Reasons for Planning Application - CB/24/00102/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those detailed on plan no. 3378 200 Rev F.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality.

3) The planting and landscaping scheme shown on approved Drawing 3378 200 Rev F shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season shall mean the period from October to March). The trees, shrubs and grass shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season with others of a similar size and species.

Reason: To ensure an acceptable standard of landscaping.

4) All ecological enhancement measures and/or works shall be carried out in accordance with the details contained in the January 2024 Ecological Design Strategy as already submitted with the planning application and agreed in principle with the local planning authority prior to determination.

Reason: To ensure that works are ecologically sensitive and do not result in adverse impacts to protected species.

5) Prior to the occupation of any dwellinghouse hereby approved, a detailed site and landscaping management and maintenance scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of landscape maintenance, and maintenance and management of the refuse collection area located adjacent to Oakwood Road to ensure the area is kept clean. The development shall be implemented in full accordance with the approved details hereby after.

Reason: To ensure that the application site is maintained to a high standard throughout the life of the development.

6) The first floor window in the side elevation of plot 9 hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the window which can be opened are more than 1.7m above the floor of the room in which the window is installed.

Reason: To safeguard the privacy of occupiers of adjoining properties

7) The proposed commercial building on the site hereby approved shall only be used as offices, within use class E(g)(i) of The Town and Country Planning (Use Classes) Order 1987 (as amended), or any Order revoking or re-enacting that Order.

Reason: To ensure that an appropriate commercial use is permitted and does not include functions which would be to the detriment of residential amenity.

8) A validation report which complies with the identified remediation identified within the Phase II Site Investigation (dated September 2021) shall be submitted to and approved in writing by the Local Planning Authority to demonstrate the effectiveness of any agreed remediation strategy prior to first occupation of any dwelling hereby permitted. The validation report shall include responses to any unexpected contamination discovered during works.

Reason: To ensure that the application site is appropriately remediated.

9) The hedgerow indicated either side of the road table at the site entrance should be planted at least 1.0m away from the table.

Reason: For the avoidance of doubt and to allow for vegetative growth without obstruction to the free flow of traffic.

10) The hedgerow in front of the fire hydrant and on the north side of the table splay should be removed or, any planting should not exceed a height of 600mm.

Reason: To provide intervisibility at the table junction with the office car park

11) The boundary treatment at the south side of the existing access/junction with the highway should not exceed a height of 600mm for at least 1.8m measured into the site from the highway boundary.

Reason: To provide adequate driver/pedestrian intervisibility.

12) There shall be no gates erected across the access/junction within the site unless otherwise agreed in writing by the local planning authority.

Reason: For the avoidance of doubt and to allow all vehicles using the site to manoeuvre, turn and leave the site in forward gear

13) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the parking provision on the site, including visitor parking spaces shall not be used for any purpose, other than as parking provision unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users and obstruct on site manoeuvring.

14) Prior to occupation,the proposed development shall be carried out and completed in all respects in accordance with the access siting and layout, cycle parking provision, refuse collection point, pedestrian visibility splays, surfacing of vehicular areas illustrated on the approved plan No. 200 rev F and defined by this permission and, notwithstanding the provision of the Town and Country Planning General Permitted Development Order 2015, (or any Order revoking or re-enacting that Order) there shall be no variation without the prior approval in writing of the Local Planning Authority.

Reason: To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent one upon another and to provide adequate and appropriate access arrangements at all times.

15) The Electric Vehicle Charging Points shall be laid out in full accordance with the details shown on plan no. 3378 200 Rev F. The approved details shall be retained as such thereby after occupation.

Reason: To promote sustainable and alternative modes of transport.
(Policy T5 of the Central Bedfordshire Local Plan and paragraph 112e of the NPPF)
16) The boundary treatment shall be completed in accordance with the details shown on plan no. 3378 200 Rev F. The approved scheme shall be implemented prior to the buildings being occupied, and shall be retained as such thereby after.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.

17) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
18) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
19) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers:
