Conditions or Reasons for Planning Application - CB/24/00153/FULL
Conditions or Reasons:
1) The intensification of use of the access way in close proximity to numbers 4 and 6 Church Road and the close proximity of the turning area to the private rear garden of number 6 Church Road would be likely to have an adverse impact on the residential amenity of the occupiers of those adjacent properties by reason of noise, nuisance and disturbance. The development is therefore considered to be in conflict with Policies CC8 and HQ1 of the Central Bedfordshire Local Plan (2021).
2) The proposed development, if permitted, would result in the intensification of use of a substandard access. Therefore, the proposal is considered to be in contrary with Policies T2 and T3 of the Central Bedfordshire Local Plan (2021), Parking Standards for New Developments (August 2023) and Section 12 of the NPPF.
3) The proposed development would, by reason of its proximity lying within a 12.6km distance of the Ashridge Commons and Woods Site of Special Scientific Interest (SSSI) within the Chilterns Beechwoods Special Area of Conservation (SAC), add to the recreational disturbance in this area, and be likely to harm the integrity of the conservation purposes of the SAC. In the absence of an appropriate strategy to mitigate this harm, the proposal would be contrary to the Habitat Regulations, Section 15 (Conserving and enhancing the natural environment) of the National Planning Policy Framework (NPPF), July 2021, and Policy EE3 (Nature Conservation) of the Central Bedfordshire Local Plan 2015 - 2035, July 2021.
