Conditions or Reasons for Planning Application - CB/24/00157/FULL
Conditions or Reasons:
1) The proposed change of use would operate on agricultural land, which has not been previously developed and would be sited in a location that is not appropriately accessible. The introduction of a commercial use in this location, in the open countryside, significantly divorced from any Settlement Envelope and public vehicular highway, is unsustainable and unacceptable. As such, the proposal is considered to be contrary with Policies EMP3 and SP7 of the Central Bedfordshire Local Plan and Section 12 of the NPPF.
2) No substantive evidence has been provided with this application to indicate that the land has any alternate use other than agricultural and no Agricultural Land Classification Assessment has been provided, in support of the proposal. The proposed change of use in this setting and location, would be deemed to result in the significant loss of Grade 3 agricultural land, contrary to Policy DC5 of the Central Bedfordshire Local Plan and Section 15 of the NPPF.
3) Due to the intensification of the use of the site and existing access road, of which contains a Right of Way; the proposal would be considered to give rise to an unsafe relationship between vehicles and users of the footway. Moreover, no Rights of Way Scheme has been provided which would demonstrate how the development would protect, enhance or promote the Rights of Way network. As such, the proposal would fail to meet the requirements within Policy EE12 of the Central Bedfordshire Local Plan and Section 8 of the NPPF.
