Conditions or Reasons for Planning Application - CB/24/00288/FULL
Conditions or Reasons:
1) The proposed development, by reason of the felling of trees T14 to T19 and its poor spatial relationship with the tree belt to the western boundary, would constitute an overdevelopment of the site that fails to adequately respond to its natural features. Consequently, the proposal would remove the screening value of these trees and create vulnerability to conflict and nuisance and thereby pressure for removal, which would be detrimental to the character of the area and the integrity of the existing tree belt. Therefore, the proposal is deemed to conflict with Policy HQ1 and Policy EE4 of the Central Bedfordshire Local Plan and Section 12 of the NPPF.
2) The intensification of use of the access way in close proximity to the host dwelling (The Birches) and Nos. 36 and 42 Church Road and the close proximity of the turning area to the private gardens of Nos. 36 and 42 Church Road would be likely to have an adverse impact on the residential amenity of the occupiers of these adjacent properties by reason on noise, nuisance and disturbance in conflict with Policy HQ1 of the Central Bedfordshire Local Plan, Section 12 of the NPPF and Chapter 11 of the Central Bedfordshire Design Guide.
3) The proposed development, if permitted, would result in the intensification of use of a substandard access which appears to make no provision for adequate driver/driver intervisibility and will lead to conditions of danger and inconvenience to users of the highway and the property in conflict with Policies T2 and T3 of the Central Bedfordshire Local Plan, Sections 9 and 12 of the NPPF and the Highway Construction Specification and Standards Guidance (2019).
4) Insufficient information has been provided to enable an accurate assessment of the application in terms of access width, parking and turning within the site in accordance with the current guidance: the Highway Construction Specification and Standards Guidance (2019) and Parking Standards for New Developments (SPD) (2023). Therefore, the proposal would conflict with Policies T2 and T3 of the Central Bedfordshire Local Plan and Sections 9 and 12 of the NPPF.
