Conditions or Reasons for Planning Application - CB/24/00413/REG3
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The proposed temporary classroom blocks shall be removed from the site by 1st September 2030, and the area of land upon which it was sited shall be returned to its current state within 3 months of their removal.

Reason: In the interest of the amenity of the surrounding area and to secure sustainability measures as would be required for a permanent building, in accordance with Policies HQ1 and CC1 of the Central Bedfordshire Local Plan (2021).
3) The surface water drainage shall be constructed to manage surface water runoff from the development for up to and including 1 in 100 year event (+30%CC), via discharge to an existing watercourse. The final detailed design shall be based on the agreed FRA and DS (Ref: BardenChapman, 23811 RP 01, 11 July 2024, P2 ) and DEFRAs Non-statutory technical standards for sustainable drainage systems (March 2018) and shall be implemented and maintained as approved. Maintenance will ensure the system functions as designed for the lifetime of the development. Any variation to the connections and controls indicated on the approved drawing which may be necessary at the time of construction would require the resubmission of those details to the Local Planning Authority for approval. The discharge rate from the development will be limited to the equivalent 1 in 1 year rate, or an appropriate rate as agreed by the Bedford Group of Internal Drainage Boards.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site, in accordance with Policies CC3 and CC5 of the Central Bedfordshire Local Plan (2021).
4) (a) Prior to the first use of the development the following documents must be submitted to and approved in writing by the Local Planning Authority after consultation with Sport England:

(i) A detailed assessment of ground conditions (including drainage and topography) of the land proposed for the playing field (as shown on drawing no. MGBC.STAE.L3 Rev 2) which identifies constraints which could adversely affect playing field quality; and

(ii) Where the results of the assessment to be carried out pursuant to (i) above identify constraints which could adversely affect playing field quality, a detailed scheme to address any such constraints. The scheme shall include a written specification of the proposed soils structure, proposed drainage, cultivation and other operations associated with grass and sports turf establishment and a programme of implementation.

(b) The approved scheme shall be carried out in full and in accordance with the approved programme of implementation. The land shall thereafter be maintained in accordance with the scheme and made available for playing field use in accordance with the scheme.

Reason: To ensure that the playing field is prepared to an adequate standard and is fit for purpose, in accordance with the aims of Para 103 of the National Planning Policy Framework (2023).
5) Prior to the first use of the development a schedule of playing field maintenance (for the area marked in green on drawing no. MGBC.STAE.L3 Rev 2) including a programme for implementation for a minimum period of five years starting from the commencement of use of the development [or other specified time period] must be submitted to and approved in writing by the Local Planning Authority after consultation with Sport England. Following the commencement of use of the development the approved schedule shall be complied with in full.

Reason: To ensure that the playing field is first established as a functional playing field to an adequate standard and is fit for purpose, in accordance with the aims of Para 103 of the National Planning Policy Framework (2023).
6) Prior to the first use of the development a scheme for the removal of the works/contractors' compound and the outdoor classroom and the reinstatement of the area highlighted in green on drawing no. MGBC.STAE.L3 Rev 2 has been submitted to and approved in writing by the Local Planning Authority after consultation with Sport England. The works/contractors' compound and outdoor classroom must be removed before first use of the development in accordance with the approved scheme.

Reason: To ensure the site is restored to a condition fit for purpose, in accordance with the aims of Para 103 of the National Planning Policy Framework (2023).
7) Before the development shall be brought into use all on site vehicular areas shall be surfaced in a stable and durable materials in accordance with details to be approved in writing by the Local Planning Authority. Arrangements shall be made for surface water drainage from the on-site vehicular areas to soak away within the site so that it does not discharge into the highway or into the main drainage system.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits, in accordance with Policies T2 and T3 of the Central Bedfordshire Local Plan (2021).
8) Prior to the erection of any lighting, details shall be submitted to and approved in writing by the Local Planning Authority and shall be implemented in accordance with those details. Any illumination shall be shielded so that no glare or dazzle occurs to drivers of vehicles using the public highway.

Reason: In the interests of the visual amenities of the locality, to protect neighbouring residents and in the interest of road safety, in accordance with Policies HQ1, T2 and CC8 of the Central Bedfordshire Local Plan (2021).
9) Part A: The development hereby approved shall be carried out in accordance with Guy, T (2024) St Andrews Lower School, Bantock Way, Biggleswade, Bedfordshire: Written Scheme Of Investigation for Archaeological Strip, Map and Sample and Watching Brief Investigation. Albion Archaeology document reference 2022/45, version 1.0, dated 8th May 2024.

Part B: This condition shall only be fully discharged when:

all elements of the archaeological fieldwork have been undertaken and the date of completion has been confirmed in writing by the Local Planning Authority
the post-excavation assessment, analysis and final archaeological report has been submitted to and approved in writing by the Local Planning Authority. This shall be done within 8 months of the date of completion of the archaeological fieldwork unless otherwise agreed in advance in writing by the Local Planning Authority
the preparation of the site archives (including the production of an archive report) for deposition at stores approved by the Local Planning Authority has been undertaken and confirmed in writing by the Local Planning Authority. For the digital archive this will include confirmation of the intention to deposit with a CoreTrustSeal certified repository dedicated to storing archaeological archives.
the publication report text has been prepared for submission to a recognised archaeological journal, or an approved final archaeological report is submitted for inclusion in the Historic Environment Record, and this has been confirmed in writing by the Local Planning Authority

Unless otherwise agreed in advance in writing by the Local Planning Authority, items 3, and 4 of Part B of this condition shall be completed within 18 months of the archaeological fieldwork date of completion.

Reason: In line with policy HE1 of the Central Bedfordshire Local Plan (2021) and paragraph 210 of the National Planning Policy Framework (Dec 2023): to investigate and record any archaeological remains affected by the development, to safeguard the long-term future of the archive and to make the record of all the work publicly available.
10) The proposed replacement trees, as detailed on plan ref. CCL 11849 / IAP Rev 1, shall be provided as shown by the end of the full planting season immediately following the first use of any separate part of the development (a full planting season means the period from October to March). Any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping and to secure biodiversity net gains, in accordance with Policies EE2, EE4 and EE5 of the Central Bedfordshire Council Local Plan (2021).
11) Prior to the first use of the proposed temporary classrooms, two bird boxes and two bat boxes shall be provided within the blue-line school site. Bird boxes shall be placed 2-4 metres above ground, and directed between north and east. Bat boxes shall be placed 4 metres or greater above ground, and direct south, south-east or south-west.

Reason: To ensure that net gains in biodiversity are provided, in accordance with Policy EE2 of the Central Bedfordshire Local Plan (2021).
12) Notwithstanding the layout of the temporary parking area, details shall be submitted to and approved in writing of a parking layout where parking spaces measure 2.5m x 5.0m each, and 3.5m x 5.0m where spaces are against a structure, and with no less than 6.0m manoeuvring area in front of the parking spaces. These parking spaces shall be implemented prior to the first use of the classrooms and retained for the lifetime of the development.

Reason: For the avoidance of doubt and to provide workable and usable parking provision, in accordance with Policy T3 of the Central Bedfordshire Local Plan (2021).
13) Prior to the first use of the proposed classrooms, details of a pupil drop off / pick up zone within the site for at least 2 year groups, with circulatory road markings and a pedestrian crossing from the parking area to the school building shall be submitted to and agreed in writing by the Local Planning Authority. The approved details shall be implemented prior to the development being brought into use and thereafter retained unless agreed otherwise in writing by the Local Planning Authority.
Reason: To alleviate an intensification of on street parking to the inconvenience of residents and users of the highway and to alleviate obstruction of the free flow of traffic, in accordance with Policy T2 of the Central Bedfordshire Local Plan (2021).
14) Prior to the removal of the modular units from the site (circa 2030) a demolition traffic management plan shall be submitted to and approved in writing by the Local Planning Authority and the approved details shall be implemented during the removal of the units. The DTMP shall include the following:

Proposed means of access and routing for larger vehicles
The erection and maintenance of security hoarding / scaffolding affecting the highway if required.
Temporary TRO footpath/footway/cycleway or road closures needed during the development period
Temporary TRO/traffic management needed during the development period.
Tracking of the low loader(s), and tracking should incorporate any overhang of the crane on the low loader
Are all low loaders arriving at once, are they staggered, where will they wait.
Tracking diagrams need to be provided of the low loader(s) and crane entering the school site, turning and leaving in forward gear.
Where will the crane be located within the site.
Where will the parking for the construction traffic be within the site? Any displaced school parking should be located elsewhere (not on street)
Any safety barriers, fencing, or other measures within the site to safely. segregate the site access and working area from other users of the site.
The provision of banksmen to manage any larger construction or delivery vehicles.
Modular units are abnormal load and the applicant will need to contact the police and the councils streetworks team.
Road plates over utility covers.
The approved Demolition Management Plan shall be adhered to throughout the demolition process.

Reason: In the interests of safety, protecting the amenity of local land uses, neighbouring residents and highway safety, in accordance with Policies T2 and CC8 of the Central Bedfordshire Local Plan (2021).
15) Prior to the removal of the modular units the applicant shall provide details to the Local Planning Authority of the proposed alterations to the on-site parking layout including the pick up / drop off area, details of the number of staff employed, details of the number of pupils registered who attend the school and details of the PAN. Any written approved assessment of the layout shall be implemented when the modular units have been completely removed from the site

Reason: To provide adequate and workable on-site parking provision for use by the school without intensifying existing on street parking, in accordance with Policies T2 and T3 of the Central Bedfordshire Local Plan (2021).
16) The approved Construction Phase Plan Rev 6 Issued 08.07.24, drawing nos. MGBC.STEA.L1 rev 3, MGBC. STEA.L2 and MGBC.STEA, L3 associated with the development of the site shall be adhered to throughout the development process.

Reason: In the interests of safety, protecting the amenity of local land uses, neighbouring residents and highway safety, in accordance with Policy T2 of the Central Bedfordshire Local Plan (2021).
17) Any existing trees which are not shown to be removed shall be protected during construction works in accordance with the details as provided in the Arboricultural Report & Impact Assessment (Crown Tree Consultancy, 30th April 2024) and on plan ref. CCL 11849 / TPP Rev 1.

Reason: In the interest of amenity and biodiversity, in accordance with Policies EE2, EE4 and EE5 of the Central Bedfordshire Council Local Plan (2021).
18) The provision of a minibus to / from the site provided by the contractor for the site operatives associated with the development of the site shall be adhered to throughout the development process.
Reason: In the interests of safety, protecting the amenity of local land uses, neighbouring residents and highway safety, in accordance with Policy T2 of the Central Bedfordshire Local Plan (2021).
19) For the avoidance of doubt, no additional / secondary access shall be taken from Bantock Way or Bridleway BW28.

Reason: In the interest of highway safety and amenity, in accordance with Policies T2, EE2 and HQ1 of the Central Bedfordshire Local Plan (2021).
20) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
21) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
22) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 100 Rev C; 101 Rev C; 102 Rev B; 103 Rev B; 104 Rev B; 105 Rev B; 106 Rev B; 107 Rev B; 108 Rev B; 109 Rev C; 110 Rev B; 111 Rev C; 112 Rev A; 113 Rev A; 114 Rev A; 115; MGBC.STEA.L1 Rev 3; MGBC.STEA.L2; MGBC.STEA.L3 Rev P2; C-1000 Rev P2; C-1001 Rev P2; G-0005 Rev P5; H-1802 Rev P2; S-1800 Rev P3; S-1801 Rev P3; S-1810 Rev P1; S-2000 Rev P2; S-2001 Rev P2
