Conditions or Reasons for Planning Application - CB/24/00564/REG3
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Within 5 years of the date of this decision, the modular building and associated play area hereby permitted shall be removed from the site and the area of land upon which it was sited shall be returned to its current state.

Reason: In the interest of the amenity of the surrounding area and to secure appropriate drainage and sustainability measures as would be required for a permanent building, in accordance with Policies HQ1, CC1 and CC5 of the Central Bedfordshire Local Plan (2021).
3) No development shall commence until a detailed surface water drainage scheme, to manage surface water runoff from the development for up to and including the 1 in 100 year event (+40%CC), and a maintenance and management plan for the scheme has been submitted to and approved in writing by the Local Planning Authority, and shall be implemented and maintained as approved. Maintenance will ensure the system functions as designed for the lifetime of the development. Any variation to the connections and controls indicated on the approved drawing which may be necessary at the time of construction would require the resubmission of those details to the Local Planning Authority for approval.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site, in accordance with Policies CC3 and CC5 of the Central Bedfordshire (2021)
4) No works above slab level shall take place until details of the type and location of boundary treatments (walls/ fencing/ means of enclosure) has been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details.

Reason: In the interest of amenity, in accordance with Policy HQ1 of the Central Bedfordshire Local Plan (2021)
5) Before the building is first brought into use, an updated Travel Plan shall be prepared, submitted and approved by the Local Planning Authority. The Plan shall contain details of:
plans for the establishment of a working group involving the School, parents and representatives of the local community
pupil travel patterns and barriers to sustainable travel
measures to encourage and promote sustainable travel and transport for journeys to and from School
an action plan detailing targets
a timetable for implementing appropriate measures and plans for annual monitoring and review
measures to manage the car parking on site
All measures agreed therein shall be undertaken in accordance with the approved Plan. There shall be an annual review of the Travel Plan (for a period of 5 years from the date of approval) to monitor progress in meeting the targets for reducing car journeys generated by the proposal and this shall be submitted to and approved by the Local Planning Authority.
Reason: In the interests of highway safety, to reduce congestion and to promote the use of sustainable modes of transport, in accordance with Policies T2 and HQ1 of the Central Bedfordshire Local Plan (2021).
6) Prior to the first use of any of the development, a landscaping scheme to include all hard and soft landscaping and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme have been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping and to secure biodiversity net gains, in accordance with Policies EE2 and EE4 of the Central Bedfordshire Council Local Plan (2021).
7) Prior to the first use of any part of the development, details of the proposed electrical vehicle charging points, including numbers, siting and design, shall be submitted to and approved in writing by the Local Planning Authority. They shall be installed in accordance with those details prior the first use of any part of the development.

Reason: In the interest of amenity and to promote sustainable transport methods, in accordance with Policies HQ1 and T5 of the Central Bedfordshire Local Plan (2021).
8) Prior to the first use of the modular building, at least 17 parking spaces shall be provided in accordance with the approved plans.

Reason: To provide adequate staff parking and usable/workable parking spaces for transport for the 12 pupils, in accordance with Policy T3 of the Central Bedfordshire Local Plan (2021).
9) Prior to the erection of any lighting, details shall be submitted to and approved in writing by the Local Planning Authority and shall be implemented in accordance with those details.

Reason: in the interests of the visual amenities of the locality and to protect neighbouring residents in accordance with Policies HQ1 and CC8 of the Central Bedfordshire Local Plan (2021).
10) The access hereby permitted shall be no less than 4.8m wide.

Reason: To allow for the two way flow of traffic and for the avoidance of doubt, in accordance with Policy T2 of the Central Bedfordshire Local Plan (2021).
11) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the parking provision on the site shall not be used for any purpose, other than as parking provision unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason
To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users, in accordance with Policy T3 of the Central Bedfordshire Local Plan (2021).
12) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Environmental Code of Practice https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
13) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
14) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers Location Plan; 26226-B-S-P-00-01; 26226-B-S-P-00-02; 26226-B-S-P-00-03; HC0135-415 Rev P03; 26226-B-S-P-00-12; 26226-B-S-E-00-01; 26226-B-S-P-00-04

Reason: To identify the approved plan/s and to avoid doubt.
