Conditions or Reasons for Planning Application - CB/24/00881/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Tree removals being permitted in respect of this development shall be confined to that shown on the "Arboricultural Impact Assessment" (Drawing No. MH9431-003 Rev A), which forms Appendix E of the supporting document "BS 5837 : 2012 Arboricultural Impact Assessment" by Maydencroft, dated July 2024 (revised August 2024).

Reason: To ensure that tree removal is confined to Trees T1-T4 (inclusive), thereby avoiding excessive or unjustified tree removal, which would otherwise be to the detriment of the existing tree cover, landscape screening and biodiversity value.
3) Prior to development, all tree protection fencing and ground protection shall be installed and positioned in strict accordance with that being shown on the "Tree Protection Plan" (Drawing No. MH9431-004 Rev A), and as specified in Section 4.2 "Timing and Order of Operations", Section 4.4 "Setting out Barriers and Construction Exclusion Zone", Section 4.5 "Ground Protection" , and Section 4.10 "Monitoring", of the supporting document "BS 5837 : 2012 Arboricultural Impact Assessment" by Maydencroft, dated July 2024 (revised August 2024). The tree protection fencing and ground protection shall then remain securely in place throughout the entire course of development works.

Reason: To protect the designated Root Protection Area of retained trees from soil compaction, excavation and contamination damage, so as to ensure that the health and anchorage of the rooting systems are maintained.
4) Throughout the course of development, all working methodology shall strictly adhere to the recommendations set out in Section 4.6 "Construction", Section 4.7 "No-Dig Construction", Section 4.8 "Tree Roots", Section 4.9 "Prohibited Activities" and Section 4.10 "Monitoring", and to the areas identified for hand digging methodology within Appendix F "Tree Protection Plan" (Drawing No. MH9431-004 Rev A) of the supporting document "BS 5837 : 2012 Arboricultural Impact Assessment" by Maydencroft, dated July 2024 (revised August 2024)

Reason: To ensure that all working methodology is carried out in strict accordance with good arboricultural practice, and fully complies with the recommendations set out in Section 4.0 "Arboricultural Method Statement", so as to ensure that trees are not damaged by construction operations and ancillary development activity.
5) Prior to first use of the development hereby approved, a detailed landscape scheme, to include a planting and maintenance specification, prepared by a suitably qualified landscape architect shall be submitted to the Local Planning Authority for approval, based on the design recommendations set out in Section 3.5 "Replacement Planting" of the supporting document "BS 5837 : 2012 Arboricultural Impact Assessment" by Maydencroft, dated July 2024 (revised August 2024). The approved landscape scheme shall then be implemented during the first planting season (November to March) following completion of development, and shall be maintained for a period of 5 years until satisfactorily established, with any losses replaced in accordance with the approved plans and specifications.

Reason: To ensure the satisfactory planting, aftercare and establishment of replacement trees in compensation for those that are being felled in the course of development, and to meet net biodiversity requirements.
6) The development hereby permitted shall be undertaken in full accordance with the Councils adopted Construction Code of Practice for Developers and Contractors https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
7) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 7928_520, 7928_523 A, 7928_521 A, 7928_522 B, 7928_524 A, GRP Meter Kiosk Details, 2558140100G01 Rev 00, GRP Cabinet, 34199_1_1_GA, 003_997.1.21_010 Rev A and Toddington BNG Post-Development Plan Rev 1.

Reason: To identify the approved plan/s and to avoid doubt.
