Conditions or Reasons for Planning Application - CB/24/01024/FULL
Conditions or Reasons:
1) The enclosure of amenity land for its use as private residential land would result in the loss of valued open space to the detriment of the visual amenity, and character and appearance of the area. The proposal would not be considered to improve or enhance the existing open space/ public realm and would instead erode and devalue its function and quality within the streetscene, contrary to Policies HQ1 and HQ10 of the Central Bedfordshire Local Plan (2021), the Central Bedfordshire Design Guide and Section 12 of the NPPF.
2) Insufficient landscape scheme has been provided with this application to evidence the replacement of the protected T1 and T2 trees. As such, the proposal would be contrary to Policy EE4 of the Central Bedfordshire Local Plan and Section 15 of the NPPF.
3) The application would result in a detrimental impact on the integrity of protected trees, where the collective group value of their shared crown would be undermined by the proposal. This would impose increased encroachment and conflict with the built form than is presently imposed by the existing building, leading to heavier, more regular and unwarranted pruning, to the detriment of the amenity value of the trees. As such, the proposal would be contrary to Policy EE4 of the Central Bedfordshire Local Plan and Section 15 of the NPPF.
