Conditions or Reasons for Planning Application - CB/24/01267/VOC
Conditions or Reasons:
1) Prior to the development hereby approved becoming operational, the existing A5 northbound Lay-By shall be relocated further south on the A5 with a Type B design. The mitigation scheme of relocating the existing northbound Lay-By on the A5 shall be carried out in accordance with Stuart Michael Associates Limited drawing title: 'Potential Relocation of Northbound Lay-By on the A5' drawing no. 6532.003 revision B, dated June 2020 (or subsequent versions approved in writing by the Local Planning Authority in consultation with Highways England).

Scheme details, to be submitted and approved in writing by the Local Planning Authority, shall include drawings and documents showing:
How the improvement interfaces with the exiting highway alignment and carriageway markings including lane destinations.
Full construction details relating to the highway improvement. This should include any modifications to existing structures or proposed structures, with supporting analysis.
Full signing and lighting details where applicable.
Confirmation of full compliance with departmental standards (DMRB) and policies (or approved relaxations/departures from standards).
Evidence that the scheme is fully deliverable within land in control of either the Highway Authority or the applicant.
An independent stage 2 Road Safety Audit (RSA) taking account of any stage 1 RSA recommendations, carried out in accordance with DMRB and advice notes.

Development shall proceed in accordance with the approved scheme.

Reason: To ensure that the A5 will continue to operate safely and efficiently as part of the strategic road network.

2) Development shall proceed in accordance with the highway scheme approved by drawings 6532.601 Rev C, 6532.602 Rev C, 6532.603 Rev C, 6532.604 Rev C, 6532.605 Rev C, 6532.609 Rev B, 6532.610 Rev C and 6532.SK17, to improve the site access arrangement onto the A5.

Reason: To ensure that the A5 will continue to operate safely and efficiently as part of the strategic road network.

3) Development shall proceed in accordance with the approved Construction Traffic Management Plan (CTMP) (Stuart Michael Associates, Ref: 7051/CTMP Issue 01, March 2023).

Reason: To ensure that the A5 will continue to operate safely and efficiently as part of the strategic road network.

4) Prior to the development hereby approved becoming operational, the turning head for service vehicles illustrated on drawing no. 6532.005 shall be constructed and shall be maintained free from obstruction in perpetuity for its intended use.

Reason: To enable service vehicles to draw off, park and turn outside the highway limits thereby avoiding the reversing of vehicles on to the highway.

5) The full planting specification for the proposed landscaping, as approved by the Planting Plan (drawing 1-116_203.1.F) and the Planting Notes (April 2024) for drawing 1-116_203.1.F, shall be implemented by the end of the full planting season immediately following the development becoming operational (a full planting season means the period from October to March). The landscaping and trees shall subsequently be maintained and retained and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.

6) The installation and positioning of tree protection barriers shall be carried out in strict accordance with Section 6.0 "Arboricultural Guidance Notes - AGN1: Installation of Tree Protection Barriers", the "Tree Protection Plan" (Drawing No. P1681-TPP01 V6), and the "Construction Exclusion Zone Notice" (Appendix 2) which form part of the "Arboricultural Method Statement" (Document Ref No. P1681-AMS01 V6), dated 16 April 2024, as prepared by Ligna Consultancy. The tree protection barriers and CEZ Notice shall remain securely in position throughout the entire course of development works, unless otherwise specified in the Arboricultural Method Statement.

Reason: To maintain an adequate and secure Construction Exclusion Zone around retained trees, so as to protect their root systems from damage incurred from all development works.

7) Throughout the course of development works, all working methodology and site supervision shall be carried out in accordance with the recommendations stipulated in the "Arboricultural Method Statement" (Document Ref No. P1681-AMS01 V6), dated 16 April 2024, and that required under its Appendix 3 "Schedule of Arboricultural Supervision".

Reason: To ensure full compliance of the Arboricultural Method Statement, so that the appropriate working methodology and procedures are correctly adopted in the course of all development works, in the interests of good arboricultural practice.

8) Once the development hereby approved becomes operational, monitoring of bat activity on site shall be undertaken with the results reported to the Local Planning Authority, and if necessary details submitted to and approved in writing to amend the scheme, and thereafter to proceed in accordance with the approved details.

To allow provision for amendments to be made to the scheme to prevent any detrimental impact to bats.

9) Development shall proceed in accordance with the approved finalised 'Maintenance and Management Plan' and 'Drainage Technical Note' for the entire surface water drainage system, inclusive of any adoption arrangements and/or private ownership or responsibilities (Drainage Maintenance and Management Plan (Stuart Michael Associates, ref. 7051/DMP, September 2023, the Drainage Technical Note reference SMA Ref: 7051.TN01, and Drive Through Scheme Drainage Layout (Drawing No. 7051.517 Rev B). Maintenance will ensure the system functions as designed for the lifetime of the development. Any variation to the connections and controls indicated on the approved drawing which may be necessary at the time of construction would require the resubmission of those details to the Local Planning Authority for approval.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site.

10) In the event that contamination is found at any time when carrying out the development hereby approved, it shall be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment shall then be undertaken by a competent person, in accordance with 'Model Procedures for the Management of Land Contamination, CLR 11'. A written report of the findings should be submitted to and approved in writing by the Local Planning Authority. Following completion of remedial measures a verification report shall be prepared that demonstrates the effectiveness of the remediation carried out. No part of the development shall operate until all remedial and validation works are approved in writing.

Reason: To provide protection from contamination risks.

11) The development hereby permitted shall be undertaken in full accordance with the Council's adopted 'Construction Code of Practice for Developers and Contractors'. https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties.

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity.

13) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 6532.LP01 Rev A, 7051.515 Rev E, 0123-B10L, 0123-B12H, 0123-B13H, 7051.520, 7051.SK26, P1681-TPP01 V6, 1-116_203.1.F, 7051.517 Rev B, 1-116 202.1.B, 1-116 202.B and 1-116 202.2.B

Reason: To identify the approved plans and to avoid doubt.
14) External artificial lighting at the development shall not exceed lux levels of vertical illumination that are recommended by the Institution of Lighting Professionals in the 'Guidance Notes for the Reduction of Obtrusive Light'. Lighting shall be minimised, and glare and sky glow shall be prevented by correctly using, locating, aiming and shielding luminaires, in accordance with the Guidance Notes. Lighting colour shall be warm in appearance and not exceeding a temperature of 3000 kelvin (K).

Reason: To ensure development is ecologically sensitive and to limit light spill onto the neighbouring Checkley Wood plantation.
