Conditions or Reasons for Planning Application - CB/24/01463/FULL
Conditions or Reasons:
1) The proposed outdoor seating area to the front of the building would give rise to unacceptable noise, disturbance and a loss of privacy for occupiers of adjacent residential properties, specifically occupiers of The Old Bakery. The proposal fails to safeguard the residential amenity enjoyed by surrounding residential occupiers, contrary to Policy HQ1 of the Central Bedfordshire Local Plan (2021) and Section 12 of the National Planning Policy Framework (NPPF) (2023).
2) In the absence of a Noise Impact Assessment, insufficient information has been provided to demonstrate that noise generated by the external extraction system would not be of a level that would result in adverse noise and disturbance for occupiers of surrounding residential properties. In the absence of such details, the Local Planning Authority are unable to establish whether the proposal would have an acceptable neighbour amenity impact in terms of noise and disturbance. Therefore, the proposal is contrary to Policy HQ1 of the Central Bedfordshire Local Plan (2021) and Section 12 of the National Planning Policy Framework (NPPF) (2023).
3) The proposal fails to make adequate provision for parking to accommodate the additional parking demands from patrons of the restaurant, staff and delivery and service vehicles that would arise from the proposal, thereby leading to an increase in parking in the area, resulting in unacceptable additional hazards and inconvenience to users of the highway and posing a highway safety risk, conflicting with Policies T2 and T3 of the Central Bedfordshire Local Plan (2021), the Parking Standards for New Developments SPD, and Section 9 of the National Planning Policy Framework (NPPF) (2023).
