Conditions or Reasons for Planning Application - CB/24/02083/FULL
Conditions or Reasons:
1) The change of use from a retail store to a takeaway would cause an intensification of use resulting in an increase in noise generated from the business itself as well as vehicles and cars over an extended period of time,  and because of its close relationship with neighbouring residential properties would cause noise and disturbance. This would cause unacceptable harm to the amenities of nearby residential properties and would result in undue harm to the character and appearance of the area. Furthermore, the proposed extraction unit would cause an unacceptable impact in terms of noise on neighbouring properties. The proposal is therefore contrary to Policy HQ1 and CC8 of the CBC Local Plan, Chapter 12 of the NPPF and the Central Bedfordshire Design Guide.
2) The proposal fails to make adequate provision for parking to accommodate the additional parking demands that would arise from the proposal, thereby leading to an increase in parking in the area, resulting in unacceptable additional hazards and inconvenience to users of the highway and posing a highway safety risk. Insufficient information has been provided to accurately assess the impact the proposal will have on the public highway, where will vehicles park including staff / delivery vehicles, where the cycle parking and bin collection point will be located, how the bins and cycle parking will be accessed and how the applicant will mitigate obstruction of manoeuvring vehicles. The proposal would be contrary to policies T2 and T3 of the Central Bedfordshire Local Plan, the Parking Standards for New Developments SPD and Sections 9 and 12 9 of the National Planning Policy Framework (NPPF) (2023).
