Conditions or Reasons for Planning Application - CB/24/02112/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to the first use of the site for the care of four (4) children, a parking scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include:

A plan demonstrating the siting of 4 or more parking spaces within the application site
Vehicular tracking of vehicles from those parking spaces to the highway to demonstrate manoeuvring of vehicles within the site and to the highway boundary
The number of staff on site at any one time and the timing of shift patterns for staff
The contact details of a site manager
 
The management of the facility shall be implemented in accordance with those details, including the demarcation of the parking spaces, and retained in perpetuity, unless otherwise agreed in writing.
 
Reason: To ensure that there is adequate parking and that there would not be danger or inconvenience to other road users, including vehicles and pedestrians, in accordance with Policies T2 and T3 of the Central Bedfordshire Local Plan 2021.
3) Notwithstanding the changes of use permitted within Part 3 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification), the development hereby approved shall only be used for the provision of residential accommodation and care to children in need of care within Class C2 of the Town and Country Planning (Use Classes) Order 1987 (or any Order revoking or re-enacting that Order with or without modification) only, and for no other purpose within C2.

Reason: To exclude the provisions of the said Use Classes Order and thereby ensure the Local Planning Authority retains full control of the future use of the land/buildings in view of the special circumstances of the case. (Section 12, NPPF)
4) No more than four children in care shall reside at the home hereby approved at any one time, unless otherwise agreed in writing with the Local Planning Authority.

Reason: In the interest of minimising the general noise and disturbance generated by the proposed use in the interest of the residential amenity of the area, and to ensure adequate parking levels, pursuant to Policies HQ1, T2 and T3 of the Central Bedfordshire Local Plan (2023)
5) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers PL.001 Rev A; PL.002; PL.003; PL.004; PL.005; PL.006 Rev B; PL.007; PL.008

Reason: To identify the approved plan/s and to avoid doubt.
