Conditions or Reasons for Planning Application - CB/24/02137/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Prior to the development hereby approved being brought into use details of improvements to the site access shall be submitted to and approved in writing by the Local Planning Authority. The details submitted for approval shall include surfacing details and identify suitable provision within the site for a Post Office service vehicle. The scheme shall be constructed in accordance with the approved details prior to the development being brought into use.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and of the site.
(Policy T2, CBLP July 2021, and Section 9, NPPF December 2024)
3) Any gates provided shall open away from the highway and be set back a distance of at least 5.0m from the nearside edge of the adopted public highway (including footway).

Reason: To enable vehicles to draw off the highway before the gates are opened.
(Policy T2, CBLP July 2021, and Section 9, NPPF December 2024)
4) Part A: No demolition or development hereby approved shall take place until an archaeological written scheme of investigation (WSI) has been submitted to and approved in writing by the Local Planning Authority. The said development shall only be implemented in full accordance with the approved archaeological scheme and the WSI shall contain the following components:

method statements for the investigation of any archaeological remains that will be affected by the development including any demolition phase; and
a strategy for post-excavation assessment, analysis, archive preparation and publication, including details of the timetable for each stage of the post-excavation works

Part B: This condition shall only be fully discharged when:

all elements of the archaeological fieldwork have been undertaken, and the date of completion has been confirmed in writing by the Local Planning Authority;
it has been confirmed in writing by the Local Planning Authority that the programme of interpretation, public outreach and community engagement has been completed;
the post-excavation assessment, analysis and final archaeological report has been submitted to and approved in writing by the Local Planning Authority. This shall be done within 18 months of the date of completion of the archaeological fieldwork unless otherwise agreed in advance in writing by the Local Planning Authority;
the preparation of the site archives (including the production of an archive report) for deposition at stores approved by the Local Planning Authority has been undertaken and confirmed in writing by the Local Planning Authority. For the digital archive this will include confirmation of the intention to deposit with a CoreTrustSeal certified repository dedicated to storing archaeological archives; and
the publication report text has been prepared for submission to either a recognised archaeological journal, or an approved final archaeological report is submitted for inclusion in the Historic Environment Record, and this has been confirmed in writing by the Local Planning Authority.

Unless otherwise agreed in advance in writing by the Local Planning Authority, items 2, 4, and 5 of Part B of this condition shall be completed within 3 years of the archaeological fieldwork date of completion.

Reason: In line with policy HE1 of the Central Bedfordshire Local Plan 2015-2035, July 2021, and paragraph 218 of the National Planning Policy Framework, December 2023, to investigate and record any archaeological remains affected by the development, to safeguard the long-term future of the archive and to make the record of all the work publicly available. Part A of this condition is pre-commencement because development works can have an irreversible impact on archaeological remains and an approved programme of investigation must be in place before the development starts.
5) Prior to the development hereby approved being brought into use details shall be submitted to and approved in writing by the Local Planning Authority of the external sound level emitted from the electrical supply equipment and of mitigation measures as appropriate. The measures shall ensure that the external sound level emitted from the electrical supply equipment shall not exceed the lowest existing background sound level in order to prevent any adverse impact. The assessment shall be made in accordance with BS4142:2014 at the nearest and/or most affected noise sensitive premises, with all equipment operating together at maximum capacity. A post installation noise assessment shall be carried out where required to confirm compliance with the sound criteria and additional steps to mitigate noise shall be taken, as necessary. Approved details shall be implemented prior to the development being brought into use and thereafter be permanently retained with the exception of specific changes to the noise details that are requested by the Local Planning Authority in writing to address statutory nuisance.

Reason: To protect the amenity of neighbouring occupiers in terms of noise impact.
(Policies CC8 and HQ1, CBLP July 2021, and Section 12, NPPF December 2024)
6) In the event of external artifical lighting being required, then prior to the development hereby approved being brought into use, details of such lighting shall be submitted to and approved in writing by the Local Planning Authority. Lighting contours shall be submitted to demonstrate that the vertical illumination of neighbouring premises is in accordance with the recommendations of the Institution of Lighting Professionals in the 'Guidance Notes for the Reduction of Obtrusive Light'. Where required details shall also be submitted for approval of measures to minimise use of lighting and prevent glare and sky glow by correctly using, locating, aiming and shielding luminaires. Lighting colour shall be warm in appearance and not exceeding a temperature of 3000 kelvin (K). Approved details shall be implemented prior to the development being brought into use and thereafter be permanently retained with the exception of specific changes to the lighting details that are requested by the Local Planning Authority in writing to address statutory nuisance.

Reason: To protect the amenity of neighbouring occupiers in terms of light impact.
(Policies CC8 and HQ1, CBLP July 2021, and Section 12, NPPF December 2024)
7) The development hereby permitted shall be undertaken in full accordance with the Council's adopted 'Construction Code of Practice for Developers and Contractors - November 2023 Update' https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties.
(Section 12, NPPF December 2024)
8) The development hereby permitted shall be undertaken in full accordance with the Council's adopted 'Environmental Code of Practice' https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity.
(Section 15, NPPF December 2024)
9) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 4248_PL104 Rev B, 4248_PL115 Rev M, 4248_PL116 Rev B, 4248_PL117 Rev A, 4248_PL118 Rev B, 4248_PL119 Rev B, 4248_PL120 Rev B, 4248_SK07 Rev A, 001_01 Rev A, 002_11 Rev A, and 002_12 Rev A

Reason: To identify the approved plans and to avoid doubt.
