| Conditions or Reasons for Planning Application - CB/24/02240/FULL |
| Conditions or Reasons: | | 1)
The proposed development represents inappropriate development within the Green Belt, which is, by definition, harmful to the Green Belt and should not be approved except in very special circumstances. The proposal, by reason of its size, massing and overall design would be harmful to the openness of the Green Belt and no factors which could amount to very special circumstances to outweigh the harm to the Green Belt have been advanced. Therefore, the proposal is contrary to Section 13 of the NPPF and Policy SP4 of the Central Bedfordshire Local Plan. |
| 2)
The proposed development would be constructed of black stained 'waney' board cladding and the proposed replacement fence would be stained black to match. By virtue of their overall design, it is considered that the proposed developments would appear out of keeping with the character and appearance of the model cottages, 40-45 Turnpike Road. As such, it is considered that the proposal would appear incongruous within the setting of the Grade II listed building, 40-41 Turnpike Road, to the detriment of its architectural and historic interest; and its prominent and positive contribution to the character of the Husborne Crawley Conservation Area. There are no public benefits which would outweigh the less than substantial harm caused to the designated heritage assets. Therefore, the proposal is considered to be unacceptable and contrary to the Planning (Listed Buildings and Conservation Areas) Act 1990, Local Plan Policies HQ1 and HE3, Section 16 of the NPPF and Chapter 5 of the Central Bedfordshire Design Guide. |
| 3)
Insufficent information has been provided within the application to demonstrate that the proposed development would not impact the Cypress tree (T1) which is protected under Section 211 of the Town and Country Planning Act 1990, by virtue of it being included within the Husborne Crawley Conservation Area. As such, the proposal would conflict with Policy EE4 of the Local Plan and Section 15 of the NPPF. |
