Conditions or Reasons for Planning Application - CB/24/02468/PAAD
Conditions or Reasons:
1) Class Q of Part 3, Schedule 2 of the Town and Country Planning (General Permitted Development Order 2015 permits: (a) a change of use of- (i) a building that is part of an established agricultural unit and any land within that building's curtilage, or (ii) a former agricultural building that was (but is no longer) part of an established agricultural unit and any land within that building's curtilage, to a use falling within Class C3 (dwellinghouses) of Schedule 1 to the Use Classes Order. Under Class Q1.b) development is not permitted by Class Q if - in the case of a site that was (but is no longer) part of an established agricultural unit - (iii) since ceasing to be part of an established agricultural unit, the site has been used for any non-agricultural purpose. Insufficient evidence has been presented to demonstrate that the buildings on site formed part of an established agricultural unit and since ceasing to be part of an established agricultural unit, have not been used for any non-agricultural purpose, thus failing the criteria in Q.1(b)(iii) of Part 3, Schedule 2 of the Town and Country Planning (General Permitted Development Order 2015. In addition, the existing access to the building(s) to be converted is considered to be deficient in respect of its visibility splays, leading to conditions of danger and inconvenience to users of the highway and the development. The application therefore fails the test at paragraph Q.1(1)(p) of Part 3, Schedule 2 of the Town and Country Planning (General Permitted Development Order 2015 which requires that the building(s) to be converted under class Q benefit from suitable existing access to a public highway.
2) The proposed development, if permitted, would result in the intensification of use of a substandard site access at Well Cottage and junction with Featherbed Lane/Lords Hill which makes no provision for adequate driver/driver intervisibility and will lead to conditions of danger and inconvenience to users of the highway and the property. The application therefore fails the test at paragraph Q.2(1)(a) of Part 3, Schedule 2 of the Town and Country Planning (General Permitted Development Order 2015.
