Conditions or Reasons for Planning Application - CB/24/03198/FULL
Conditions or Reasons:
1) The proposed dwellings by reason of their constrained backland siting will appear incongruous and out of keeping with the existing pattern and grain of the area. The development does not therefore represent high quality design and will fail to the overall quality of the area, contrary to Policies HQ1 and HQ8 of the Central Bedfordshire Local Plan (2021), Central Bedfordshire Design Guide (2023) and the National Planning Policy Framework.
2) The proposed dwellings by reason of their siting, scale, form and design will result in a constrained layout and design, leading to an unacceptable overbearing impact, loss of privacy and overshadowing to existing and future occupiers. Therefore, the proposal is not considered to be of a high standard of design or layout and is contrary to Policy HQ1 of the Central Bedfordshire Local Plan (2021), the Central Bedfordshire Design Guide (2023) and the National Planning Policy Framework.
3) The proposed development would result in intensification in use of an access at a point where visibility is substandard, resulting in danger and inconvenience to users of the access and to highway users in general, contrary to Policy T2 of the Central Bedfordshire Local Plan (2021) and the National Planning Policy Framework.
4) The applicant has not included adequate provision for space within the site for the parking of vehicles clear of the highway in accordance with Central Bedfordshire Council's Parking Standards for New Developments SPD. The development if permitted would be likely to lead to additional demand for on-street parking which is contrary to highway safety and the free flow of traffic along the highway, contrary to Policies T2 and T3 of the Central Bedfordshire Local Plan (2021) and the National Planning Policy Framework.
5) The applicant has not included adequate provision for a satisfactory turning space within the site for a fire tender. The resultant reversing of vehicles onto or off the highway would lead to danger and inconvenience to users of the highway, contrary to Policy T2 of the Central Bedfordshire Local Plan (2021) and the National Planning Policy Framework.
6) On the basis of the information provided within the application, it has not been satisfactorily demonstrated that the proposed development would be exempt from providing a 10% net gain in biodiversity. Therefore, the proposed development would not be in accordance with Policy EE2 of the Central Bedfordshire Local Plan (2021), Section 15 of the National Planning Policy Framework or Schedule 7A of the Town and Country Planning Act 1990 (as inserted by Schedule 14 of the Environment Act 2021).
