Conditions or Reasons for Planning Application - CB/24/03382/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers: DD 24 / 159.1, DD 24 / 159.2B.

Reason: To identify the approved plan/s and to avoid doubt.
3) No development shall commence until all tree protection barriers and ground protection are installed and positioned in strict accordance with Sections 6.1, 6.2 and Appendix 3 'Tree Constraints/Protection Plan' of the supporting document 'Tree Survey Report Pre-Development' dated November 2024, as prepared by RGS Arboricultural Consultants. All tree protection barriers and ground protection shall then remain securely in position throughout the entire course of development works.

Reason: This is a pre-commencement condition to establish a secure Construction Exclusion Zone around the designated Root Protection Areas of retained trees, or to guard against compaction and contamination damage where limited encroachment is being permitted, so as to protect their rooting systems and rooting medium from construction damage, contractor access and ancillary development activity (Sections 12 & 15, NPPF).
4) The garage shall only be used for purposes incidental to the enjoyment of the dwelling.

Reason: To prevent the introduction of an inappropriate use harmful to the residential character of the area.

5) Tree works undertaken in the course of this development shall be restricted to that specified in Appendix 2 'Survey Schedule' and as shown on Appendix 3 'Tree Constraints/Protection Plan' of the supporting document 'Tree Survey Report Pre-Development' dated November 2024, as prepared by RGS Arboricultural Consultants.

Reason: To ensure that tree removal is limited to Groups G1 and G2, and that further pruning work on tree T1 is only that required to facilitate construction, so that unnecessary or unjustified tree work is thereby avoided, which would otherwise be to the detriment of the quality of the surrounding landscape (Sections 12 & 15, NPPF).
6) Throughout the course of development, any routing of services to the garage that will pass thorough the designated Root Protection Areas of adjacent trees will require that an
Arboricultural Method Statement is submitted to the Local Planning Authority for approval, and must be based on the recommendations laid down under the National Joint Utilities Group (NJUG) Volume 4 'Guidelines for the Planning, Installation and Maintenance of Utility Apparatus in Proximity to Trees'. The approved Arboricultural Method Statement shall then be implemented in strict accordance with the required working methodology.

Reason: To ensure that all service provision does not damage the designated Root Protection Areas of retained trees from excavation damage, as highlighted in Section 6.3 of the supporting document 'Tree Survey Report Pre-Development' dated November 2024, as prepared by RGS Arboricultural Consultants (Sections 12 & 15, NPPF).
7) No development shall take place above slab level until a landscaping scheme to include all hard and soft landscaping and details of replacement boundary hedge along the eastern boundary and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme have been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.

8) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing building.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match the existing building in the interests of the visual amenities of the locality.
