Conditions or Reasons for Planning Application - CB/24/03438/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The land shall only be used, or part used, for Use Class B8 of the Schedule 1 to the Town and Country Planning (Use Classes) Order 1987 (as amended) (or any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order with or without modification), and no other purpose.

Reason: To exclude the provisions of the said Use Classes Order and thereby ensure the Local Planning Authority retains full control of the future use of the land.

3) All stored items shall be stored, stacked or deposited within the hatched areas labelled Plot 1 and Plot 2 on approved drawing ref: BIG-ASA-ZZ-ZZ.ZZ-D-A-0003_(S0-P6). Any impervious items to be stored shall be raised to a minimum of 300mm above ground levels (28.10 AOD), as described in Section 4.9 of the submitted Flood Risk Assessment (Weetwood, ref: Final Report v1.1, dated November 2024). Any goods, waste, stored items or other materials shall not exceed a height 3 m from ground level.

Reason:

In order to reduce the risk of flooding to the proposed stored items and to prevent flooding elsewhere by ensuring the free passage of water (Section 14, NPPF), in the interests of ecology (Section 15 NPPF), and to safeguard the appearance of the completed development and the visual amenities of the locality.

4) The paladin fencing hereby approved shall be fully implemented prior to first use of the site and shall permanently be kept clear, as described in Section 4.8 of the submitted Flood Risk Assessment (Weetwood, ref: Final Report v1.1, dated November 2024).

Reason:

In order to reduce the risk of flooding to the proposed stored items and to prevent flooding elsewhere by eusuring the free passage of floodwater (Section 14, NPPF)
5) The turning space for vehicles illustrated on the approved Plan No TR01 Rev A, Vehicle Swept Path Analysis (Transport Statement, Pulsar, dated November 2024) shall be constructed before the development is first brought into use and retained throughout the lifetime of the development.

Reason:

To enable vehicles to draw off, park and turn outside the highway limits thereby avoiding the reversing of vehicles on to the highway (Policy T2, Central Bedfordshire Local Plan, 2021)
6) All ecological measures and/or works shall be carried out in accordance with the details contained in the November 2024 MKA Ecology Preliminary Ecological Appraisal (including Section 5) as already submitted with the planning application and agreed in principle with the local planning authority prior to determination.

Reason: To ensure that works are ecologically sensitive and do not result in adverse impacts to protected species.
(Section 15 of the NPPF).
7) No external lighting shall be installed on the site.

Reason: To protect the residential amenity of neighbouring properties and/or highway safety.

8) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers BIG-ASA-ZZ-ZZ.ZZ-D-A-0001_(S0-P3); BIG-ASA-ZZ-ZZ.ZZ-D-A-0002_ (S0-P5); BIG-ASA-ZZ-ZZ.ZZ-D-A-0003_(S0-P6); BIG-ASA-ZZ-ZZ.ZZ-D-A-0004_ (S0-P1); Flood Risk Assessment (Weetwood, ref: Final Report v1.1, dated November 2024); Preliminary Ecological Appraisal (MKA Ecology Limited, ref: 165024, version 2, 28/11/2024); Biodiversity Net Gain Technical Note (MKA Ecology, November 2024); Transport Statement (Pulsar, Issue 2, dated 26/11/2024); TR01 Rev A, Vehicle Swept Path Analysis

Reason: To identify the approved plan/s and to avoid doubt.
