Conditions or Reasons for Planning Application - CB/25/00085/FULL
Conditions or Reasons:
1) The proposed development does not constitute limited infilling in a village as the site is located in countryside outside of and not within the village of Kensworth. The proposal would also not be considered infill as the site is not located within a built up frontage and the proposal would have an adverse impact on the setting of the site and the character of the area. The proposal is inappropriate development within the Green Belt and would be harmful by reason of inappropriateness, loss of openness and detrimental visual impact and would conflict with the purposes of including land within the Green Belt by way of encroachment of the countryside. Very special circumstances that would outweigh the identified harm have not been established in this case. Therefore, the proposal would conflict with Policy SP4 of the Central Bedfordshire Local Plan (2021) and Section 13 of the National Planning Policy Framework (2024).
2) The proposal would consolidate existing sporadic development in a rural location which is outside the built-up part of the village of Kensworth and would be detrimental to the appearance and rural character of the area, which lies within a National Landscape. Therefore, the proposal would conflict with Policies, EE5, EE7 and HQ1 of the Central Bedfordshire Local Plan (2021), Section 5 of the Central Bedfordshire Design Guide (2023) and Section 12 and 15 of the NPPF (2024).
3) Insufficient ecological information has been provided with this application to evidence the protection and / or enhancement of species, habitats and biodiversity at the application site. Therefore, the proposal would conflict with Policy EE2 of the Central Bedfordshire Local Plan and Section 15 of the NPPF (2024).
4) The proposed development would, by reason of its proximity lying within a 12.6km distance of the Ashridge Commons and Woods Site of Special Scientific Interest (SSSI) within the Chilterns Beechwoods Special Area of Conservation (SAC), add to the recreational disturbance in this area, and be likely to harm the integrity of the conservation purposes of the SAC. In the absence of an appropriate strategy to mitigate this harm, the proposal would be contrary to the Habitat Regulations, Policy EE3 (Nature Conservation) of the Central Bedfordshire Local Plan (2021) and Section 15 of the NPPF (2024).
5) Insufficient information, which would be required in the form of an archaeological desk-based Heritage Statement, has been submitted with this application to demonstrate that there would be no harm to archaeological remains which would represent heritage assets. Therefore, the proposal would conflict with Policy HE1 of the Central Bedfordshire Local Plan (2021) and Section 16 of the NPPF (2024).
