Conditions or Reasons for Planning Application - CB/25/00364/VOC
Conditions or Reasons:
1) The proposed variations to condition 20 would involve the creation of a new means of access to a public highway. This is operational development which requires planning permission since the means of access would be to an unclassified road but would be required in connection with development which requires planning permission (so not falling within development permitted by Class B of Schedule 2, Part 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended)). The proposed variations would therefore conflict with the operative part of the original planning permission (CB/23/01769/FULL) and would conflict with the original description of development. It is therefore considered that the proposal cannot be considered positively through the application as submitted under section 73 of the Town and Country Planning Act 1990.
2) The proposed access would increase the number of points at which vehicles enter and leave the public highway. This additional access point would unnecessarily add to the danger and inconvenience inherent in accesses to the highway and would have an adverse effect on road safety and the flow of traffic. The proposal is therefore in conflict with policy T2 of the Central Bedfordshire Local Plan, the Central Bedfordshire Highway Construction Standards & Specifications Guidance and section 9 of the NPPF (2024).
