Conditions or Reasons for Planning Application - CB/25/00370/FULL
Conditions or Reasons:
1) By reason of the excessive scale and siting of the proposed dwellings, the proposal would represent a cramped form of back-land development that would be at odds with the existing pattern and grain of development of the surrounding area, whereby the character and appearance of the area would be harmed, contrary to Section 12 of the National Planning Policy Framework (2023), Policy HQ1 and HQ8 of the Central Bedfordshire Local Plan (2021) and the Central Bedfordshire Design Guide.
2) Insufficient information has been provided to demonstrate that the proposed dwellings would be able to achieve a sustainable relationship with existing trees to be retained within the site without causing harm to trees. Additionally, the proposal would involve the removal of Category C tree's, which are of a condition that could not be sufficiently replicated through replacement planting as part of a landscaping scheme due to insufficient space between the boundaries. As such, on the basis of the information provided, the Local Planning Authority are not satisfied that the proposal would have an acceptable impact upon trees, contrary to Section 15 of the National Planning Policy Framework (2023) and Policy EE4 of the Central Bedfordshire Local Plan (2021).
3) The Council considers that the proposed development, by reason of its proximity lying within a 12.6km linear distance of the Ashridge Commons and Woods Site of Special Scientific Interest within the Chiltern Beechwoods Special Area of Conservation, would add to the recreational disturbance in this area likely to harm the integrity of the conservation purposes of the Chiltern Beechwoods Special Area of Conservation. In the absence of a legal obligation to secure an appropriate mitigation strategy to the satisfaction of the Local Planning Authority, the proposal would be contrary to the Habitat Regulations, Policy EE3 of the Central Bedfordshire Local Plan (2021), and Section 15 of the National Planning Policy Framework (2023).
