Conditions or Reasons for Planning Application - CB/25/00547/PAEC
Conditions or Reasons:
1) The development hereby permitted shall be completed not later than three years from the date of this permission.

Reason: To comply with MA.2(5) of Part 3, Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
2) A minimum of one car parking space and one cycle parking space shall be made available for use by the residents of each flat prior to occupation of that flat. Prior to occupation of 50% of the development, a minimum of 11 car parking spaces shall be made available for use by visitors (separate and additional to the one space per dwelling), and prior to full occupation of the development a minimum of 22 car parking spaces shall be made available for use by visitors (separate and additional to the one space per dwelling). A minimum of six cycle parking spaces shall be provided for visitors prior to full occupation of the site. The parking provision for the development shall be provided in accordance with the approved details and retained for occupiers of the development and their visitors for the perpetuity of the development.

Reason:
To ensure adequate parking provision for the development hereby permitted without adversely affecting the convenience of site and road users, and in the interest of encouraging the use of sustainable modes of transport amongst site users.
3) Before the development hereby permitted is commenced, a site investigation and asbestos survey shall be carried out to establish whether the site is contaminated, to assess the degree and nature of any contamination present, including asbestos within the existing buildings/structures on the site, and to determine its potential for the pollution of the water environment and risk to other receptors.  The method and extent of the investigation shall be agreed with the Local Planning Authority prior to the commencement of work, but for the avoidance of doubt shall be carried out according to the requirements of the Local Planning Authority, including BS 10175:2011+A2:2017 Investigation of potentially contaminated sites Code of practice and in compliance with and by a competent person who conforms to Land Contamination Risk Assessment (LRCM) guides.

Reason: To prevent significant harm to people and or significant pollution of surface waters or groundwater.
4) If required by the survey carried out under Condition 3 of this permission, a method statement setting out the proposed means of dealing with any contamination and asbestos present on the site, including measures to prevent pollution of groundwater and surface water, shall then be submitted in writing to the Local Planning Authority for approval before the development commences. The remediation strategy shall set out a timetable of works and the proposed means of dealing with any contamination and asbestos on site, including provisions for monitoring any specified actions and validating the outcomes. The development shall then proceed in strict accordance with the measures approved. If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the local planning authority) shall be carried out until the developer has submitted a remediation strategy to the local planning authority detailing how this unsuspected contamination shall be dealt with and obtained written approval from the local planning authority. The remediation strategy shall be implemented as approved. All works must be carried out in compliance with and by a competent person who conforms to Land Contamination Risk Assessment (LRCM) guides.

Reason: To prevent significant harm to people and or significant pollution of surface waters or groundwater.
5) Following completion of remediation works (if required by Condition 4 of this permission), the developer should submit a Verification Report to the Local Planning Authority for approval prior to the commencement of development. The Verification Report should provide confirmation that all measures outlined in the approved Remediation Strategy have been completed including where appropriate validation testing. All works must be carried out in compliance with and by a competent person who conforms to Land Contamination Risk Assessment (LRCM) guides.

Reason: To prevent significant harm to people and or significant pollution of surface waters or groundwater.
6) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers WHD.U6.EX.01, WHD.U6.EX.02, WHD.U6.EX.03, WHD.U6.EX.04, WHD.U6.EX.05, WHD.U6.PR.01, WHD.U6.PR.02, WHD.U6.PR.03, WHD.U6.PR.04, WHD.U6.PR.05, WHD.U6.PR.06 and FSRR.01.PR.07.

Reason: To identify the approved plan/s and to avoid doubt.
