Conditions or Reasons for Planning Application - CB/25/00562/VOC
Conditions or Reasons:
1) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plan numbers L-03 rev O and L-12 rev B and plan numbers 01 rev J; L-08 rev I; L-10 rev C; L-15 which formed part of permission reference CB/24/03337/VOC dated 09 January 2025 and plan nos. L-02 rev A; L-07 rev D; L-09 rev C; and document title: 'External Materials Schedule', which formed part of permission reference CB/23/04018/VOC dated 11 June 2024.

Reason: To identify the approved plan/s and to avoid doubt.
2) The development hereby permitted shall be undertaken in full accordance with the Council's adopted 'Construction Code of Practice for Developers and Contractors' https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning.

Reason: In order to minimise the impact of construction work on the amenities of nearby residential properties (Section 12, NPPF)
3) The development hereby permitted shall be undertaken in full accordance with the Council's adopted 'Environmental Code of Practice' https://www.centralbedfordshire.gov.uk/info/44/planning/674/codes_of_practice_for_planning/3

Reason: In order to minimise the impact of development on existing trees, landscape features and biodiversity (Section 15, NPPF)
4) The surface water drainage scheme shall be carried out in complete accordance with the details approved under reference CB/24/00648/DOC dated 23rd April 2024.

Reason: To ensure the approved system will function to a satisfactory minimum standard of operation and maintenance and prevent the increased risk of flooding both on and off site, in accordance with CBC Local policy CC3 to CC5 and the NPPF (2024).
5) The Maintenance and Management of the surface water drainage system shall be carried out in complete accordance with the details approved under reference CB/24/00648/DOC dated 23rd April 2024.

Reason: To ensure that the implementation and long term operation of a sustainable drainage system (SuDS) is in line with what has been approved, in accordance with Written Statement HCWS161, 18th December 2014
6) The vehicular access into the site shall be carried out in complete accordance with the details approved under reference CB/24/00648/DOC dated 23rd April 2024.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises and in the interest of road safety and to reduce the number of points at which traffic will enter and leave the public highway
7) Visibility splays of 2.4m x 43.0m shall be provided at the junction of the access with the public highway before the development is brought into use in accordance with the approved plan no. L-03 rev K. The required vision splays shall for the perpetuity of the development remain free of any obstruction to visibility.

Reason: To provide adequate visibility between the existing highway and the proposed access and to make the access safe and convenient for the traffic which is likely to use it.
8) The proposed vehicular access and parking areas shall be surfaced in accordance with the annotation on the approved plan no. L-03 rev O. The porous surfacing shall remain as stipulated unless otherwise agreed in writing by the local planning authority.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety
9) Any gates provided shall open away from the highway and be set back a distance of at least 8.0 metres for the central access and 5.0m for Plot 1 access from the highway boundary. Any gates for the central access shall be free of obstruction to opening to all traffic using the site and the turning area.

Reason: To enable vehicles to draw off the highway before the gates are opened and turn and leave the site in forward gear
10) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the parking provision on the site, including visitor parking, shall not be used for any purpose, other than as parking provision unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users
11) The turning space for vehicles illustrated on the approved Plan no. L-03 rev O shall be constructed before the development is first brought into use and remain thereafter free of obstruction for the purpose of vehicle turning.

Reason: To enable vehicles to draw off, park and turn outside the highway limits thereby avoiding the reversing of vehicles on to the highway
12) The refuse collection point located at the site frontage and outside of the public highway and any visibility splays shall be fully implemented prior to occupation of any dwelling and shall be retained thereafter.

Reason: In the interest of amenity and in order to minimise danger, obstruction and inconvenience to users of the highway and the premises
13) Notwithstanding the approved plans, any boundary planting at the site frontage shall be planted no less than 1.0m measured into the site from the highway boundary.

Reason: For the avoidance of doubt and to avoid vegetative encroachment of the public highway where it will cause an obstruction
14) The proposals for Electric Vehicle Charging Points shall be carried out in complete accordance with the details approved under reference CB/25/00561/DOC dated 24th February 2025

Reason: To assist with the transition to low-emission vehicles in line with Policy T5 of the Central Bedfordshire Local Plan, the Council's adopted SPD: Electric Vehicle Charging, Technical Guidance for New Development (2022), and paragraph 114 of the National Planning Policy Framework (2024).
15) All dwellings hereby approved must comply with the water efficiency standard of 110 litres per person per day as detailed by Regulation 36(2)(b) of Part G of Schedule 1 and Regulation 36 to the Building Regulations 2010 (as amended).

Reason: To ensure the efficient use of water in accordance with Policy CC1 of the CBLP (2021) and the objectives of sustainability set out in the NPPF (2024).
16) The site levels for the development shall be carried out in full accordance with the details approved under reference CB/24/02144/DOC dated 13th November 2024.

Reason: To ensure that an acceptable relationship results between the new development and adjacent buildings, private amenity spaces and public areas, in accordance with Policy HQ1 of the Central Bedfordshire Local Plan (2021) and the NPPF (2024).
17) The fire hydrants serving the development shall be carried out in full accordance with the details approved under reference CB/24/02144/DOC dated 13th November 2024.

Reason: In the interests of fire safety and providing safe and accessible developments. (Section 7, NPPF (2024)
18) At no time shall the flat roof areas serving Plot 3 hereby approved, be utilised as external balconies.

Reason: To safeguard the privacy of neighbouring properties.
